The regular monthly meeting of the Town of Tompkins Town Board was called to order at 7:00 pm in the Town meeting room, Trout Creek, NY.

On motion by Buttel, seconded by Stuendel,  it was moved to approve the minutes of the September 13, 2010 meeting as each member had received a copy.

On motion by Buttel, seconded by LaTourette,  it was moved to receive, approve and place on file the Town Clerk’s monthly report.

The Town’s Financial Statements and Budget Report were reviewed with the Board by Nancy Roberts, Bookkeeper to the Supervisor.  Noteables – A partial payment CHIPS money that had been applied for in August was received; Received projected 2012 retirement figures showing an increase of $33K to $49K.   All need to be aware of the ongoing increases in costs.

On a motion by Stuendel, seconded by Buttel, it was moved to receive, approve and place on file the Supervisor’s Monthly Financial Report.

Visitor Questions –

Craig Fritzsch – Question regarding the status of the burned out crane.  Mr. Fritzsch would be willing to give the town $1000. for equipment.  Bill Layton responded that the equipment had been sold by the company to India and the company that owns the crane is in process of removing it.  Work on the physical removal had started earlier this week.  Was decided this was a moot issue at this time.

Reports-Superintendent – Ron VanValkenburg

Dryden-Gray Rd. – replaces 3’ pipe with 5’x40’ squash and collar – cost $4150 plus headwall stone.  A question was raised by Stuendel as to whether or not Stream Mgnt would pay for any of this work.

Faulkner Rd – headwall on discharge end fell over during the flood.  Repair scheduled for Thursday

Rain storm – have been doing repairs to roads and have cut up and removed fallen trees

Carcass Brook – worked the road and cut the bank back.  Made ditch deeper. Used 50 loads gravel

Shop – Have performed a lot of truck repairs and changing tires.  Dana Wagner has been welding supports under boxes

Concrete for addition Town Hall has been poured and finished.

Violation – The Building Inspector has issued a violation on pole barn exit.  A roof is needed as there is a danger to personnel as the snow/ice freezes the door and entry way.

On motion by LaTourette, seconded by Backus, it was moved to resolve/correct the building violation.

Emergency Assessment Form – Bill Layton asks Ron if the form was completed for the flood damages on 9-30-2010 and 10-1-2010.  Ron responded that he faxed the day after the flood that minimum damage resulted with and estimated cost of $33,000 not including labor and equipment usage and cost.

Concrete pad in back of shop – Last year’s estimated price was $6,680.  Ron questioned if this is to be completed now.  The pad would make the washing of trucks cleaner and safer for the personnel as the area becomes very muddy and slippery.  Discussion ensued as to where the money would come from.  Town is awaiting response on the Court Bldg. Fund Grant Application. Bill will follow up on the status of the grant.

On motion by Layton, seconded by Buttel,  it was moved to table the decision regarding work on the pad until next month after review of the financial situation.

Reports- Planning Board – James Fox

No report submitted.  The Board asked Sandy to contact James Fox and request a report for the last few months and impress on him the importance of timely reports.

Reports – Assessor – Joyce Ottens

Bill Layton indicated the reports for September had been mailed to Town and received the day after last month’s meeting.  The report for October meeting was received.  Bill read both reports which seemed to be basically the same.  Bill Layton is going to follow up on court case and to make sure that she include in her reports any communication with attorney Robert Bebe, who represents Town of Tompkins in its ongoing struggle with NYC over tax assessments.

Reports – Dog Control Officer – Brenda Thurston

New monthly report format – Gail Crane presented the new monthly report that Brenda, Sandy and she had created.  In summary, there were 7 complaints/assistance requests from homeowners; 2 dogs removed to the shelter, no dogs relocated.   Bill Layton indicated he thought it was too detailed, Carl Stuendel indicated he liked seeing the detail.  Bill requested that the detailed report be emailed to the Board prior to the monthly meeting.

Enumeration project status – a 911 worksheet by street has been generated and the Dog Control Officer has begun visiting each location to count the dogs.   During this process a number of dogs in violation have been found.  Discussion ensued as to whether or not the violations should be addressed at the time of the violation being discovered – or after the entire enumeration project completed.    Suggested process by Dog Control Officer is –

Step  1.  Verbal warning, at time of violation discovery during enumeration visit

Step  2.  A letter from the Town Clerk indicating violation discovered and license/rabies vaccination required within 30 days.

Step  3.  Follow up by Dog Control Officer 30 days after letter sent.  Issuance of summons if the violation had not been corrected.

Database status – As required by the State, Dog Licenses for renewals and control will be turned over to the Town to administer effective January 1, 2011.  Renewal notices, tags, etc.     Establishment of an accurate database of current dogs is in the process. As reported last month 188 letters to all previously licensed dogs that were past due were sent out.  A good response has been had with the database being updated from the returned letters where the dog owners have indicated the dog is deceased or been moved.

The process that has been established at this time is:

Step 1 – Create the database from all previously issued dog licenses on file in Town Clerk’s office.  COMPLETE

Step 2 – Send a letter to ALL previous dog owners where dog license is past due for renewal.  COMPLETE 188 letters sent

Step 3 – Dog Control Officer to follow-up on review of the database

Step 4 – Dog Control Officer to issue corrective action for un-licensed dogs.

A discussion ensued on the pros/cons of the enumeration and dog licenses database issues.

During the process of reviewing the returned notices, there is an instance where a dog has been reported as deceased dog but the Dog Control Officer knows the dog is alive and is in violation of license.   During the discussion, Gail raised the question of legal liabilities of the Town’s enforcement or lack of enforcement regarding rabies vaccinations.  Can the Town be sued if a dog has not had the rabies shot as required, and by chance bites a person or if the dog is not holding a current license?  A discussion of pros/cons ensued.

Further discussion ensued on the license renewal process.  Should all licenses be renewed in June or on anniversary date.   Sandy indicated the annual renewal in June was not working.   Gail indicated the system is all set to generate automatic renewal notices.   Gail also indicated that her understanding at the last Delaware Town Clerks Association meeting that most towns were renewing based on anniversary date.  Bill asked that the Town Clerk contact various towns again to confirm their  renewal process.  We agreed to table a decision regarding dog license renewal dates until next meeting when we would have more information on whether the town might be able to provide a rabies clinic three times a year.

On motion by Stuendel, seconded by LaTourette, it was moved to pursue corrective action on all violations discovered as a result of the enumeration or database review process.

Dog Rabies & Spay Neuter Clinic – Brenda has been working with the vet Dr. Pritze on trying to establish a rabies clinic.  Dr. Pritze gets .50/mile.  It is believed that fund raising or donations is legal to help support this.  Brenda requests permission to hold a couple of fund raising events – Bake Sale and Penny Social in support of a rabies clinic.  Rabies clinics are currently held at various times throughout the county by the Delaware County Public Health Dept.

On motion by Stuendel, seconded by Buttel, it was moved to allow Brenda to hold a fund raiser.

Reports- Supervisor – Bill Layton

Resolution on Cannonsville Cemetery – Resolution # 10 for transferring the Cannonsville Cemetery from the Cannonsville Cemetery Association to the Town of Tompkins was reviewed and signed by the Board.

Grant Stream Mgmt Program – project clarification Rt 206 and Trout Creek stream needs refining.  The County has offered their assistance in reviewing and correcting the grant application process.

Correspondence – Bill Layton

Letter of resignation effective November 1, 2010 has been received from Sandra Gardepe, Town Clerk due to health reasons.  The current Deputy Town Clerk, Gail Crane, was asked if she would be able and willing to take on the job for the next few months or year.  This is an appointed position.  Gail indicated she was willing to assist until a new Town Clerk can be appointed or elected.  The flexibility of time for Gail is a concern as she travels out of state quite often.  Gail is willing to work with a replacement person to teach or assist where possible.

On motion by LaTourette, seconded by Stuendel, it was moved to table the acceptance of the resignation at this time.

Budget

The tentative budget as established be previous meeting was reviewed and discussed.  There had been no changes since the previous budget review meeting of September.  Concern was voiced by Tim LaTourette regarding the Highway personnel budgeted amounts and lack of replacement personnel budget.  Discussion of where funds would come from if and when replacement personnel is determined to be needed as it is not spelled out in the current budget.

On motion by Layton, seconded by Stuendel, it was moved accept preliminary budget and bring before a public hearing.

On motion by LaTourette, seconded by Stuendel,  it was moved to approve the Abstract of Claims for  October 12,  2010 as follows:

Reports-Superintendent – Ron VanValkenburg
1. South Dry Brook sealed
2. Performed cold patch and mowed roads
3. Assisted Town of Deposit seal roads
4. Readburn Mt. – working on the road, aware it is a bit slimy. Have had no complaints. Ditching, cut brush. Will cut more before winter. Changed 5 pipes
5. Have question on the snow plow contracts with the county – what is the expiration date. Bill thought they were good for 3 more years. Bill will get a copy for Ron.
6. International truck – Needs dyno testing. Milton Cat does not have tools needed to test. The truck seems to be losing power on the hills. Problem has been for over a year, truck has 80K miles on it now. Bill indicates money is low but we should get a quote before work is performed. Board agrees that we need to get it on record with CAT that problems exist before warranty expires. Ron to validate paperwork on truck regarding warranty.
7. The D6 bulldozer – very old machine – parts are falling of. Tracks and brackets are worn out. Estimate of over $12,000 for parts, not including labor, for repairs. The machine is used only during floods, then needed a lot, otherwise it has minimal use. Question is – Do we fix it or not? Bill Layton will bring up in Budget meeting.

Reports – Dog Control Officer – Brenda Thurston
No report submitted this month by Brenda.
Gail Crane gave an update on the new dog license database created. The database currently has a count of 345 dogs. Of this 345 dogs, 188 dogs are past due for license, 93 dogs are deceased or no longer valid, 64 dogs have valid licenses. Letters have been prepared and will be mailed this week to the dog owners of past due licenses. Brenda Thurston will follow up with any past due license with no response to the Town Clerk’s office.

In regards to the Dog Enumeration Program, Gail Crane has received and prepared a listing of all addresses by Street Name for Brenda to use as a worksheet.

Gail Crane has created a Summary Dog Control Monthly Report form for Brenda to use monthly in reporting to the Board. This will be used in conjunction with the current Enumeration Sheet and Trouble Call Sheet.

Job Description is required for the Dog Control Officer. There may be one already in the Town Book. Bill requests to have Sandy look up any existing job description. Actually, a job description for all employees of the Town should be established.

1. West Branch Delaware River Stream AKA Delaware Watershed Stream Mgnt Program Grant – 57 projects Watershed, 10 high priority, 3 medium priority
Town got accepted for 1 grant – small project for taking trees out of creek.
Bill said this was a very good learning experience and will prepare us for future applications. Town can submit another grant application in October. Contacts – Ron is primary and Butttel is the secondary. Ron/Howie are to attend meetings and give voice. During discussion of this topic, Ron brought this item to the board’s attention: Agreement — Ron gave gravel to state from putting stream back and is supposed to receive grindings from the state highway.
2. Cannonsville Cemetery – We have a person (Sandy Jewel) who is interested in purchasing plot and burying her husband. There are many unresolved questions and procedures to be established. Question raised as to what other Towns do. It was decided to have Sandy Gardepe contact various towns for copies of their procedures and to contact Normal Carlson to find out who did the burials and grave digging. Also to find out which is the latest maps and current pricing on plots. All agree that responsibilities need to be established and procedures developed.
3. BOCES – addition to building. Ground was broke today for the addition. Footing is done. Want to make sure a timely schedule is adhered to. Also want to make sure the invoices for the addition from Jess Howes are on a separate statement.
4. Dog Licenses – effective January 2011 Town is required to take over the dog licensing issues. Budget lines need to be established for this additional expense. Gail/Sandy have been at work setting up a dog database. New town ordinance is required to be established and a public meeting will be required. There is supposed to be a transitional worksheet of info being sent in the near future to assist to setting this all up.
5. Budget items for the future – Electronic file system of sub-division laws, resolutions, local laws, etc. need to be setup on the computer and availability to the public set up on our website. Legislation is required for dog licenses. Public hearings – no changes without a public hearing
6. Kingswood – Hathaway Pond – want to establish 5-6 permanent campsites to be used by church functions. Will not house permanent trailers but travel trailers that would come and go based on various church functions. Sewer system permits have already been granted. Joe Reynolds submitted a question of what type of permit and fee is required. Ron noted that any change to driveway or road entrance may require a site plan review. Just in case roads are damaged. Would a resolution and public hearing be required for establishing a campground? Board needs to look more into this matter. Health issues checked OK. Bill will get more information and call the board members.
7. Trout Creek signs – Letter received from Hannah Wagner regarding construction of “Welcome to Trout Creek” signs. Discussion that state lands may require permission from state. Peggy volunteered to shop around for sign prices.
8. Culvert for snowmobilers on Bridge Street. May be either a bridge or a pipe. If snowmobilers purchase the pipe the town can put it in – must be at least 20 foot long. Motion was made by Peggy, seconded by Carl for the snowmobilers to purchase the pipe and the town to do the installation. Vote: All AYEs – Motion carried.
9. Discussion regarding speed limit in Trout Creek. Previous letters submitted to the state attempting to get speed reduced was unsuccessful. Board suggest perhaps a petition would be able to get established and submitted to the state. Board can contact the Sheriff’s Dept. and request speed to be monitored. Bill will contact the Sheriff’s Dept.
10. Budget – Nancy has prepared tentative budgets that are ready for review. Budget meeting date Thursday, 9-16-2010 7:00 PM set up.
11. Town of Tompkins state retirement payment has increased by 30% over last year’s amount.
12. New Oath of Office cards for Howie and Peggy need to be obtained for 2011. Sandy to obtain new cards.

Reports – Superintendent

  1. Pat Hanley gets $63 per hour for repairs. This was in answer to the question about the bill on the 1995 Chevy.
  2. Work done- changed pipes, cut brush, did repairs, weed eating, and painted posts.
  3. Next week (19th) will be putting down 2 inches of pug mill mix on S Dry Brook Rd should take 2 days.
  4. Helped Masonville put down pug mill mix 7-12-2010.
  5. Readburn Rd ditching, cutting trees and brush.
  6. Put down gravel on Alger Rd, Carroll Hill Rd, Beers Rd, and Fletcher Hollow Rd.
  7. Took out a gravel bar by the bridge on Carroll Hill Rd.
  8. 3 Trucks went to Hanley’s to fix the AC. Broom AC needs fixing. Massey new clutch and bearings.
  9. Worked on Lookout Rd. Widened the entrance from Herrick Hollow Rd, took out a stone wall for better vision. Took out trees and made the turn around bigger and put down gravel.
  10. Put all brand new pipes on Lookout rd.
  11. The Superintendent will take the old computer over to the Hwy Department. We will check to see if there is a wireless connection available.

Dog Control Officer – Brenda Thurston spoke about the over population of dogs. The Delhi Shelter gave us some vouchers for spay and neutering. Need to have some fund raisers for more of the vouchers .Brenda needs permission from the Board to hold the fund raisers.  On motion by LaTourette seconded by Stuendel it was moved to give Brenda permission to hold the fund raisers for additional vouchers for spay and neutering.    Vote: All AYEs       Motion carried.

The money that is raised goes to the Delhi Shelter and they give out the vouchers.

On motion by Stuendel seconded by Layton it was moved to advance to Brenda up to $200 for gas for enumeration and trouble calls if necessary. Brenda will begin using a form for Enumeration and Trouble Calls and will turn in a monthly report.

Reports – Supervisor

  1. The Town’s Financial Statements and Budget Report were reviewed with the Board by Nancy Roberts, Bookkeeper to the Supervisor.  June Bank statements were not available as of now. There are potential shortfalls in Highway Dept income from Delaware County and NY City of an estimated $20,000 due to less snow plowing during the winter.  Potential budget overrun in Highway Equipment Repair.     On motion by Backus, seconded by LaTourette, it was moved to receive, approve and place on file the Supervisor’s report.   Vote: All AYEs – Motion carried.
  2. Grant for the new addition- The Court Clerk gave the Supervisor a letter about a grant that the Town can apply for the new addition and courtroom equipment.  Court Clerk Lynne Carlstrom will do the paperwork for the grant when it becomes available.  On motion by Stuendel seconded by Layton it was moved to file for a grant from the Justice Department for new addition and courtroom equipment when it becomes available.    Vote: All AYEs       Motion carried
  3. Walton Fair Board sent a thank you letter to the Town for our donation towards the new horse barn.
  4. Teague land- the owner paid the taxes owed.
  5. The Supervisor told Mr. Wagner about what the Assessors said at our special meeting.
  6. On motion by Backus seconded by Stuendel it was moved to pay Charles Koehler $25 for trying to serve a summons.    Vote: All AYEs            Motion carried.
  7. Correspondence – None
  8. The summons on the property (tax map #227.1-1-11) that Mr. Koehler attempted to serve was discussed at length by the Board.

On motion by Backus seconded   by LaTourette   it was moved to approve the Abstract of Claims for July 12, 2010 as follows:       General Fund: $ 4,933.95        Highway Fund:$23,012.82

The special meeting of the Town of Tompkins Town Board was called to order at 7:00 pm in the Town meeting room, Trout Creek, NY.

The Board asked the Assessor Joyce Ottens several questions regarding how property is assessed. Joyce Ottens will be at the next grievance day.

a-      The assessment rate is 6%.

b-      For example 6 acres split from a 50 acre parcel. The assessment will not be a percentage it will be based on what the person paid for the 6 acres.

c-      Assessment for a new building includes cost of the building and materials used, well, septic, foundation and electric. Assessment will be what the cost to build was.

The Building Inspector may pick up differences in houses when he inspects.  Property (tax map #248.-1-12.2) is assessed at $90,000 and was the subject of comparison to other homes at the Grievance Day meeting. This may have been a partial assessment and will be revisited. After July 1, 2010 when the final roll has been filed for the property cannot be changed. Class codes do not really mean a lot regarding the assessment. If a land owner takes their assessment to court, the assessor goes to represent the Town.

Monthly Financial Reports: Nancy Roberts went over the monthly financials with the Board.  During the review it was discussed that DA530.4 Hwy Equipment & Repairs Contractual account is higher than expected and required close monitoring and control for the balance of the year.  Bill Layton will speak with Ron VanValkenburg on this.

  2. Delaware Watershed Program for Soil and Water Grants – application was submitted by Howie Buttel and Ron VanValkenburg on time.  Thanks for the work on this.
  3. Richard Boggiano, Dryden Brook Rd. called & voiced concerns regarding the new “public access” status of the land owned by the City adjoining his.  Was/is there anything the town can do about this.  His concern is that people will be encouraged to trespass on his land.  The board felt there was nothing they could do regarding the status of the city land and they would just encourage Mr. Boggiano to post his land well with signage.
  4. Tammy & Richard Wagner attended meeting to discuss the property tax grievance meeting and the tax assessment of their property.  They had questions as to how their assessment was calculated and why Joyce Ottens did not attend the grievance meeting.  Walt Ottens sat in on the meeting in her place and they questioned the status of certification of Walt Ottens.  Mr. & Mrs. Wagner stated they have comparable properties that have lower taxes than theirs.  They had obtained a permit and demolished a trailer that had previously been on their property and they expected a larger tax reduction than they received on that.  Bill Layton indicated he will schedule a meeting with Joyce Ottens and the Assessment Review Committee and get back to Mr. & Mrs. Wagner.
  5. Status of new addition to Town Hall Building – Matt Lawrence has the plans for the new addition completed.  Low estimate of $8400 for material (excluding concrete and heating).
  6. Bill received correspondence from Superintendent of Delaware County which indicated the county mechanics have attended a one week course on International Truck maintenance.  The Board felt this could be a cost efficient benefit to our town as our Hwy. Dept. can ask for advice/assistance from the county in future.
  7. Letter was received from the Court Clerk indicating a need for a petty cash fund for the court.  Uses of this fund would enable the court to give change to people who are paying fines with cash.  On motion by Stuendel and seconded by Buttel a petty cash fund of $75.00 would be set up.  Vote:  All ayes, motion carried
  8. 3 PO requisitions from Highway Superintendent reviewed and approved.

Abstract of Claims:

Question was raised by Backus as to the labor rate for brake repair.  Seemed high.  Bill will speak with Ron to get comparative pricing on future rates.

Delaware Watershed Stream Management Grant Program

Gale Neale and Jennifer Wallens spoke about the grant program. The Town will be the first to file for applications. After that landowners can contact the Town with their projects.

We need a primary person and a secondary person for the Project Advisory Committee (PAC).Howard Buttel will be primary and Ron VanValkenburg will be secondary temporarily. The Town figures that we have four (4) projects. Applications a due by June 1, 2010.

The Board agreed on option (C) of the Tompkins Town Hall Addition as presented by Matt Lawrence. The Judge’s Chambers and the Courtroom will be flipped and four(4) more feet will be added to both rooms. The ceilings will be ten (10) feet.

The Board requested that Matt provide them with a list of materials he gave them a rough estimate of $30 per square foot, roughly $20,000 to $30,000. Town Employees will do the digging and concrete work for the addition.

On motion by Buttel seconded by Stuendel it was moved to pay Matt Lawrence a deposit of $250 on his fee of $1000.

Reports – Dog Control Officer, Brenda Thurston
Brenda reported that her calculations indicate that expenses are greater than income at this point by approximately $1300. Brenda suggests the Board re-consider a suggestion made by her a few months ago of adding an enumeration fee of $1.00 to $5.00 on each dog license sold to help offset/re-coop the expenses. Town Board agreed they had debated this issue a few months ago. It was decided to leave license fees as they are without any added on enumeration fee.

Brenda indicated some additional clerical assistance from the Town Clerks office would be beneficial in sending out letters to dog owners regarding status of licenses. Letters have been developed and are awaiting Sandy Gardepes return from sick leave.

There have been several complaints of dogs creating nuisances and defecating on ballfield. The current law is vague regarding licensed dogs and free range. The current law does indicate action can be taken when nuisance or defecating is becoming a problem and tickets can be issued. The real problem is that owners are not being responsible. Ticketing dogs will require support of the courts and the Justice. Board suggests a warning be issued to dog owners and if the problem continues than to give ticket.

The Board commended Brenda on doing an excellent job and her efforts with the Dog Control issues.

7. Cutting and chipping brush on South Dry Brook. Did receive a complaint today by landowner on So. Dry Brook indicating 2 trees (50 years old in landowner’s estimation) were removed and she may want re-imbursement for replanting costs. Ron will investigate to assure the trees were within the 25 foot right away and get back to Board and Landowner.

b. Stadium bill – lawyer status – After further negotiation, the invoice is now $3880 which is significant decrease from the last invoice of $4770. (The original invoice was approx. $7700.) There is a legal fee of $375. Our lawyer recommended we pay the bill as it stands and have our COD status removed at Stadium. All Board members agreed.
c. Truck purchase – Tim LaTourette informed the board there was no state bid out yet this year and the way things look, there may not be one. The truck committee indicates that the 2010 Chevy at cost of $30-31K which Tim believes is the Gov’t Fleet price is the best buy. On motion by Tim LaTourette seconded by Carl Stuendel, it was moved to purchase the 2010 Chevy from Scoville Meno, Bainbridge.

f. Kingsbury summons status – Summons was served and he appeared in court. Time deadline is the 22nd (1 month). Joe Reynolds will be looking into what the next step will be.
g. Retirement Program – Standard Work Day & Reporting Resolution – the resolution has been typed and requires the Town Clerk’s signature & seal. This covers all elected officials who want to be on the retirement program. All participants were asked to keep track of the hours they each had worked in January, February & March of 2010. The hours worked can vary between individuals holding the same position. On motion by Carl Stuendel seconded by Tim LaTourette, it was moved to accept this resolution.

h. Letter from Guntown Post 1554 was received thanking the Town for their support.
i. Letter from CWC – The grant application for recreation applied for jointly with Deposit was denied.
j. US Dept. of Commerce (Census) sent letter thanking the Town for their support in making the Town Hall available to the Census Bureau staff to conduct testing and training.
k. Trout Creek Post Office – The post office is asking for support to keep the post office open. Asking the board to spread the word.
l. The October 2009 modification to the Town Sub-division laws – letter from DEP, SEQRA Coordinator, Marilyn Shanahan to Supervisor Layton dated January 11, 2010, was submitted to the board for consideration. Carl Stuendel said he would look into the meaning of the comments that she made.
m. Lawn mowing – On motion by Tim LaTourette seconded by Carl Stuendel, it was moved to place a Notice to Bidders on lawn mowing in the paper.

n. Shared Service Agreement – Copies of the Shared Service Agreements of Walton, Hancock, Masonville, Deposit and Hamden were reviewed. A committee of Nancy Roberts and Ron VanValkenburg was established to write up a new sharing agreement based on the Hamden’s agreement. On motion by Howard Buttel seconded by Tim LaTourette, it was moved to accept the sharing agreement as written based on the Hamden agreement.

s. Bill Layton to set up a meeting with CWC Attorney Tim Cox to discuss New York City’s pending lawsuit against the Town of Tompkins regarding land taxes.
t. Discussion of court clerk’s pay rate. Bill said that when Lynn was hired, he mis-communicated what the jump in pay rate would be after her first month. After an involved discussion, on motion by Carl Stuendel seconded by Howard Buttel, it was moved to adjust her March pay from $350 to $400 and start paying $500/month as of April instead of May 2010 (since she completed her training one month early). Bill will again emphasize to Lynn the Town’s request that she keep track of her hours and that next year the pay rate will be re-established with the budget process.
u. Computer – question whether to move to Hwy Garage or not. Cost for DSL would be outside the existing budget. Decision to hold off on the move and to have it shared with Joe, Brenda and Ron within the Town’s Office Building.

  2. Bids received from Ken Reynolds, Carver Sand & Stone, and Shane Strong on stone, stone dust.    After some discussion, it was determined there were errors in the legal notice.  The legal notice needs spelling corrections, and more specific stone requirements spelled out.
    Discussion of type of stone – from Hancock (bluestone) requiring more oil.  Bill Layton will clarify with Wayne Reynolds, Commissioner of Public Works, Delaware County the differences in the stone product.

  5. Shared agreement for working with other towns.  Does Tompkins have one?  Howard Buttel thought we had an agreement still in effect.  Bill Layton will review the Resolutions and see if one exists.  If not, he will get one made.
  6. Violence in Workplace training session on March 16, 2010 10:00 AM Town Bldg, North St. Walton.  Recommended audience is Town Clerk, Board Members, Supervisor, Highway Superintendent and crew.  Session is given by the State.  Information available from Walt Geidel, HWY Superintendent, Walton.  Board approved for Ron VanValkenburg and his crew to attend.  All the Board members have conflicts.
  7. Mandatory Hearing tests were held at County offices Friday March 5, 2010.  Town will be receiving an invoice.
  8. Snow Storms February 23rd and 25th, 2010.  Ron may have to do additional paperwork as required by Delaware County Disaster letter if the storms are declared as a disaster.
  9. Trucks – one sent to Stadium and one sent to Milton Cat for repairs.
  10. Grader – Replaced and refaced blade and serviced and repaired brakes.  Town will be getting an invoice from Dana Wagner for the repair.
  11. Regular maintenance was performed on equipment and trucks.  Cut brush, plowed and cindered,  Hauled 10 loads grit and more hauled today.
  12. Dana Wagner has been helping Highway Dept. out with problems.  Welded on grader blade.  He has been an excellent assistant to the Town.
  13. Snowplowing – We have plowed 18 fewer snows for the County and City this year than last year so we can expect less money in from the County and City than we anticipated in the 2010 budget.
  14. Press that went thru the fire is back in working order again.
  15. Boiler – United Plumbing,  who set up the system 5 years ago, sent in a sub-contractor to assist in determining the problem with the boiler.  It was determined the thermostat to run the shutters were working opposite way incorrectly.  United Plumbing changed the thermostat/shutter settings and now we have heat.
  16. John’s truck – changed bearings in drive line.  Had a vibration in transmission or somewhere.  Two more trucks were sent to Binghamton.
    Sam’s truck was sent to Milton Cat – has oil blow-by in breather pipe.  Warranty is the same of all of the trucks.
    Scott’s truck was sent to Stadium.  Called International and had to have check first.  We got the check and purchased the part, installed the replacement part but did not fix the problem.  So we took the new part back off the truck and put it into parts inventory and sent the truck in for repair.
  17. Our lawyer has been in touch with Stadium and had a discussion with Nate and Don.  Frank told Ron they are going to try to get more money from CAT.  Stadium indicated there were “too many idling hours and dirt getting into oil”.  Ron completely disagrees with that statement.   So warranty issue is not resolved and is still under discussion.

    1. Treatment plant – nothing new since last meeting.   At last Board meeting Bill ran into another lawyer who indicated that it may be a community septic system rather than a sewage treatment plant.

Truck purchase – Truck committee reports that Tim has requirements selection lists sample and has 2 weeks to get state bid.  Bill indicated Hancock and Kortright has same problems and they are buying older trucks.  Diesels are a quality concern. Committee will meet and make determination before next meeting.
    4. Follow-up on the Feb. 16, 2010 meeting with property owners in the newly defined floodplain:  Carl reports that he will be meeting with Tom Evans and Henry Lamont to see if affected landowners have any grounds for appeal.  Rick Wote, who has been working on floodplain map issues in neighboring communities, will also be consulted.  In addition to providing personal narratives and photographs, affected property owners can expect to pay approximately $500 to a surveyor for an elevation certificate.  If Board members are asked, they can be telling people to check with their mortgage-holding bank to see if they will be required to purchase flood insurance and to check with their home-insurance company to see what the flood insurance rates will be.  Tim is running out to file a comment and/or appeal.  March 24, 2010 is the deadline.
    5. Letter from DuMond regarding employees using Town vehicles for personal use.  Bill Layton wrote a response and the Board Members approved signed it.
    6. Building Addition – drawings A/B/C reviewed – 40 ft. option would be right over the current septic system.  Bill indicated will have plans changed.  1500 sq ft. does not require an architect stamp any longer per Joe Reynolds.  Will save Town money.
    7. Tony’s Shoe Store – Regarding our program for the Highway Crew to purchase their safety boots at Tony’s Shoe Store in Walton—All members of the highway crew have now obtained their safety boots for 2010.  Frank thanked the Town for our business.
    8. Housing Permit-Delaware Opportunities –Grants to fix up places for elderly or low income families.  Uses bid process.  Question is whether the Town will waive the building permit, approx. $185 for the Housing Grant process.  Usually the permit is obtained by the contractor.  On motion by Bill Layton, seconded by Peggy Backus, it was moved to NOT waive the building permit fee.
    9. Kingsbury –  violation hearing – someone has to serve this legal paper.  Bill will check with the sheriff to see if he can serve the papers.  If not Bill will check with Tom Mills to see what the going rate is to have papers served.  Peggy will also check her contact.  We don’t have much time as the hearing is scheduled for March 18th.
    10. Bill received letter from the Chief of Fire Dept.  They have gotten a grant for a new tank truck.  Town determined it needs to establish a “Grant Committee” to see if we can garner some money for the Town.
    11. Trout Creek Cemetery – Looks like the Town is going to have to take over this maintenance function.
    12. On motion by Carl Stuendel, seconded by Tim LaTourette, it was moved to give an increase of $50 per month to Lynn (Court Clerk) as she has completed the first month of her three month training period with flying colors.  Looks as though less hours of work per month may be required than was originally planned.  We’ll have to continue to monitor the hours.

On motion by Carl Stuendel, seconded by Tim LaTourette, it was moved to purchase 2 new copies of “The Office of the Town Highway Superintendent” available from the Association of Towns at cost of $10.00/each.  The copy the Town currently has is from 1990 and is obsolete.

Abstract of Claims:

On motion by Tim LaTourette seconded by Peggy Backus it was moved to approve the Abstract of Claims for February 2009 as follows;

General Fund: $    5,616.75

Highway Fund:$ 26,208.73

Vote: All AYEs – Motion carried.
