The regular monthly meeting of the Town of Tompkins Town Board was called to order at 7:00 pm in the Town meeting room, Trout Creek, NY. With M. Phoenix leading in the Flag salute.

Floor Time/Guests: J. LaTourette was here to explained his frustrations with the new communication system and the Fire Department having many issues with communication to the County when the Fire Department is toned out for emergencies. Josh LaTourette drafted a letter to send to the County in frustrations of the system and had presented it to the board. The letter was read outload and with some minor adjustments it will be sent to the County with the boards backing. Albanese also stated that we can contact the Town attorney to send a letter to the county board of supervisors stating we need the communications fixed immediately or we will be prepared to file suit against the county to protect our residents in the event of an emergency.
Bid Opening: Tim LaTourette handed in a bid/quotes for a 2023 Silverado 2500HD. Matthews fax of
$54,000 (no formal bid received), Cobleskill Chrysler (Ram 2500 Big Horn 2022) $54,255 (picture of window sticker) and DeNooyer (2023 Chevy Silverado 2500 HD Summit white) $50,380.00 and installation of running boards $1,295.00 total with tax $51,872.50 (bid assist number FAN #856351) No official bid received.
RESOLUTION # 85 – 2022
On motion by Albanese, seconded by Layton it was approved to go with the quote received from DeNooyer excluding the installing of running boards. For a 2023 Summit white Silverado 2500HD in the amount of $50380.00 tire fee of $12.50, NYS ins fee $10 and another dealer fee of $175.00 total of $50,580.50.

RESOLUTION # 86 APPROVALS OF MINUTES
On motion by Backus, seconded by Buttel, approving the minutes of the Regular meeting held on November 10, 2022.

RESOLUTION # 87 ABSTRACT OF CLAIMS
On motion by Albanese, seconded by LaTourette, it was moved to approve the Abstract of Claims for December 13, 2022 as follows: General Fund: $ 56,235.55 Highway Fund: $81,257.72.

RESOLUTION # 88 TOWN CLERKS MONTHLY REPORT
On motion by Albanese, seconded by Backus it was moved to receive, and place on file the Town Clerks, monthly report for November 2022.

RESOLUTION # 89 SUPERVISOR MONTHLY FINANCIAL REPORT
On motion by LaTourette, seconded by Buttel it was moved to approve and place on file the supervisor’s monthly financial reports as of November 30, 2022 dated 12/13/2022.

RESOLUTION # 90 SEWER DISTRICT ABSTRACT OF CLAIMS
On motion by Backus seconded by Layton to approve the sewer districts Abstract of Claims for December 13, 2022 as follows $7,378.53.

RESOLUTION # 91 – SEWER DISTRICT FINANCIAL
On motion by Albanese seconded by LaTourette it was moved to approve and place on file the sewer districts monthly financial reports as of November 31, 2022 dated 12/13/2022.

OLD BUSINESS – None
NEW BUSINESS –
On motion by Backus, seconded by Albanese to change line item 1420.4 Attorney Personal from $12,000 to $2,000 and to add line item1320.4 (audit Contract) of $10,000. To also change Tax line levy of 2023 to $1,069,052.00 to $1,069.074.00.

Reviewed contract with Hancel that expired in 2019. Albanese would like to see section 9 – Liability and Indemnification (B-1). To increase liability to $1,000,000.00 from 500,000.00 for personal injury or death for one person. And to up the 1,000,000.00 to 2,000,000.00 for personal injury or death of any two persons. Also, to add an umbrella of $5,000,000.00. Remove a copy to go to lawyer DeGroat in Section 20 – 0.
This will be reviewed at next month meeting before approval.

RESOLUTION # 93 – January 1, 2023 – December 31, 2025 Collective Bargaining Agreement
On motion by Albanese, seconded by Layton it was moved to approve and place on file the January 1, 2023 – December 31, 2025 Collective Bargaining Agreement between the Town of Tompkins and Teamsters Local 317 as presented with the signatures of all the Highway crew.

REPORTS:

Highway Superintendent –
- Reported Trucks are ready
- Reported all equipment has been cleaned and stored in creamery
- Reported grit has been hauled
- Reported roads have been checked
- Reported the radiator has been changed in 2007
- Reported that stone bids for 2023 need to go out.
- Josh LaTourette reported he has received prices from Stevenson Equipment for replacement and or new John Deere with Mower. They expect to get approximately $40,000 in trade in value of the tractor that would be traded in.
- Josh LaTourette reported that a new 10-wheeler truck is needed and received prices from Allegiance for a 2024 & 2025 Peterbilt. 2024 – $168,279.00, 2025 – 175,572.58. These trucks come with no box and plow which will have to be added.
Supervisor –
- Reported he has received the permit for admittance from NYC. The permit allowed entrance from Rt 10 to fire tower. When the Town receives the right of way the permit will be modified.
- Reported that he was contacted by Delaware County that a resident of the Town of Tompkins had complained to them about the Town repairing the fire tower. Layton was told by the County that the County has nothing to do with the issue and they just passing this along.
Other: Albanese was approached by C. Kinney that the Town may have the choice to adopt a local that would exempt up to 10% of assessed value for a primary home and they served at least 2 years for volunteer fire responders This is a new bill that the Governor just put out. The board discussed this and it will be looked into further.
Albanese needs the 2021 audit report to be emailed to him so that Jason Waite of Mostert, Manzanero & Scott LLP (independent auditors) and send engagement letter and start the audit.
