The regular monthly meeting of the Town of Tompkins Town Board was called to order at 7:00 pm in the Town meeting room, Trout Creek, NY. With Howard Buttel leading in the Flag salute.

RESOLUTION # 85 APPROVAL OF MINUTES
On motion by LaTourette seconded by Buttel, approving the minutes of the Regular meeting held on October 10, 2023.
Vote: All in favor – Motion Carried  

RESOLUTION # 86 ABSTRACT OF CLAIMS
On motion by Buttel, seconded by LaTourette, it was moved to approve the Abstract of Claims for November 9, 2023, as follows:
General Fund: $11,652.57
Highway Fund: $26,725.57
Vote: All in favor – Motion carried.

Monthly Financial Reports:
RESOLUTION # 87 TOWN CLERK’S MONTHLY REPORT
On motion by Albanese, seconded by LaTourette, it was moved to receive and place on file the Town Clerk’s monthly report for October 2023.
Vote: All in favor – Motion Carried

RESOLUTION # 88 SUPERVISOR’S MONTHLY FINANCIAL REPORT
On motion by LaTourette, seconded by Buttel, it was moved to approve and place on file the supervisor’s monthly financial reports as of October 31, 2023, dated 11/09/2023.
Vote: All in favor – Motion Carried.

On motion by Albanese, seconded by Buttel, to move the monies from the NBT HWY Equipment Reserve Savings Account into an NBT HWY Equipment Reserve CD; and also, to move $350,000.00 out of the NBT General Fund Checking Account into a new General Fund Checking Account at Wayne Bank.
Vote: All in favor – Motion Carried

RESOLUTION # 89 SEWER DISTRICT ABSTRACT OF CLAIMS
On motion by LaTourette, seconded by Buttel to approve the sewer district’s Abstract of Claims for November 9, 2023, as follows:
$8,790.40
Vote: All in favor – Motion carried.

RESOLUTION #90 SEWER DISTRICT FINANCIAL
On motion by Albanese, seconded by LaTourette, it was moved to approve and place on file the sewer district’s monthly financial reports for October 31, 2023, dated 11/09/2023. 
Vote: All in favor, Motion carried.

OLD BUSINESS:
RESOLUTION # 91 TO ADOPT THE 2024 PRELIMINARY BUDGET AS THE 2024 FINAL BUDGET
On motion by LaTourette, seconded by Albanese, to adopt the 2024 Preliminary Town and SD Budget as the 2024 Final Budgets.
Vote: All in favor – Motion carried.

Fire Tower – Nothing New. Still waiting for NYC permit

UTV’s on Highway Roads – Layton spoke to Town of Colchester officials about how they are handling this issue; they are having a public comment period. He provided a copy of Stamford’s town law for the board to review. The board will wait to see how the public review and passage progresses in other towns, and assess the situation based on their experience. The board will keep this on the old business list to review and update each month.

Walking Trail – Layton found portion of the trail will go through swamp land. Layton spoke with a landowner boarding the trail to see if they would allow a portion of the trial to go across their property and hasn’t heard back from them.

NEW BUSINESS:
Michelle received questions from a property owner on if the Town allows and what needs to be done to sell cannabis. The board stated, “regardless of the products she wishes to sell, the Town does not have any zoning regulations against commercial property and she can open any type of business providing all NYS laws are followed with the business”.

Sewer District Worker’s Report – None

Assessor – None

Planning Board – None

Dog control Officer – None

Highway Superintendent

  • Ron reported new pipes have been put in on Readburn road.
  • Ron reported that scrap has been taken in.
  • Ron reported that grit has been hauled
  • Ron reported that equipment has been worked on
  • Ron submitted a price on a new boom mower and tractor. Albanese stated he was not in favor of buying a new 2nd new tractor this year and would recommend the town to repair the one we currently own. There was no decision made on purchase.
  • Ron reported the backhoe was tipped on its side moving the grit pile. There was very little damage and no one got hurt. Ron was advised that an accident report needs to be filled out.

Supervisor –

  • Layton stated an insurance representative visited the Town and reviewed all the Town has and stated all looks good.
  • AG & Mrkts reviewed the DCO and passed.
  • Layton questioned if the Town would like to get an ATM. The board decided to review this at a later date.

Other:
LaTourette questioned if the Town would be willing to allow an electric sign installed in the field between 206 the Town building to display Fire department and Town advertisements. This will be looked into further.

The Quilt at the end of the Town building needs attention, Layton stated he will look into it.
