NYC avoided having to build a federally mandated water filtration plant for its water supply by agreeing to a number of conditions summed up in the historic 1997 Memorandum of Agreement (MOA).  This agreement had a duration of ten years with an automatic five year extension and so was set to expire in 2012.  Negotiations between the Coalition of Watershed Towns, Catskill Watershed Corporation, Delaware County, various environmental groups, US EPA, NYS DEC and NYC DEP among other principals of the original MOA, has resulted in the Successor Water Supply Permit (S-WSP) which was issued on Dec 14, 2010.  A key requirement of the S-WSP (and the original MOA) is the Land Acquisition Program whereby NYC is required to purchase land in the watershed region to keep it from ever being developed.  The idea is that developed land will lead to the production of effluents that could result in the deterioration of water quality.  However, hamlets within the watershed were allowed to expand their borders and were given the option to exclude NYC from acquiring land or easements within these borders.

Dean and Shelly were here to discuss the decisions the town board would have to make regarding the hamlet of Trout Creek.  They told us that in 1997 the Town of Tompkins had chosen not to exclude NYC acquisitions within the designated hamlet area of Trout Creek and that several years ago the town board had chosen not to expand the hamlet of Trout Creek.

They told the board that it would have to 1) affirm the current borders of the hamlet, 2) decide whether it would allow acquisitions or easements within the designated hamlet area.  If it wanted to exclude acquisitions and easements, the board would have to notify land owners by mail of this inclination and schedule a public hearing.  If the board allowed individual owners to opt out of this exclusion, i.e., to opt out of being included in the hamlet area, then the owners should know that if they were near a watercourse, they would no longer be allowed to build within 100 feet of it.

They said there were three other decisions the town board would have to make for the Town of Tompkins as a whole with respect to NYC acquisitions and easements: 1) whether to waive the ten acre minimum lot size requirement in floodplains, 2) whether to waive the ten acre minimum lot size in the entire town, and 3) whether to allow land trusts acting as agents for NYC to acquire land within the town.

They told us they would come back to discuss these matters further after we had a chance to talk it over on the board and with members of the community within the designated hamlet area.

Judy Pangman – Project Manager, Lamont Engineers

Judy reported the status of the wastewater management program. A map was shown with the projected sewer pipe lines, with other numerous bits of information.

Judy stated it will be apx. 18 months before construction and a year and half from then until completion.

Judy presented to the board the forms required to initiate the SEQR process for the Trout Creek Wastewater Management Project

On motion by LaTourette, seconded by Stuendel, it was moved to adopt Resolution 2011 #5. Resolution of the Town Board of the Town of Tompkins seeking lead agency status in construction of the wastewater management project in the hamlet of Trout Creek.

Monthly Financial Reports:

On motion by Layton, seconded by Stuendel, it was moved to receive, approve and place on file the Town Clerk’s January 2011 monthly report.

Supervisor’s Report:

The Town’s financial Statements and Monthly Financial Audit were reviewed with the Board by Nancy Roberts, Bookkeeper to the Supervisor.

On motion by Stuendel seconded by Backus it was moved to receive, approve and place on file the Supervisor’s Financial Report and the Annual Financial Audit.

Report – Planning Board

Report – Assessor

Michelle received Assessor report via email from Joyce Ottens and was read.

Report – Highway Superintendent

  1. Water separators were pumped out at the shop.
  2. Used $11,268 in diesel fuel, an average of $380 a day
  3. Paper shed is full, need some boxes to empty it.
  4. 2004 Chevy 1 Ton is at Hanley’s – Found to not be getting fuel. The problem could be the fuel tank or the injectors. Howie Stated there may be a recall on this truck for this issue and Ron should look into this.
  5. After repairs to the turbo’s on the 2007 International, the bill comes to apx. $3330.
  6. Having to do a lot of small repairs to the trucks (Brake hands, etc) due to what the State is putting on the roads.
  7. Would really like the board to reconsider the budget for the grit pile. So far this year with the amount of snow we are getting they are ahead in grit usage and pile is dwindling faster than prior years.
  8. Need requests for stone and pipes bids put out in the paper
  9. We need to talk to resident on Cemetery Road about trimming back the bush on the corner.

Report – Dog Control Officer

  1. On 1/19/11 1 Adult dog and 1 puppy was dropped off at the Thurston residence, They were taken to the Crescent Pet Lodge on 1/20/11
  2. On 1/17/11 received a call about 2 beagles that were missing. On 1/21/11 received a call about two beagles seen at the pull off on County RT 27 by Morman Hollow Rd. After locating the dogs at Oralls junk yard a call was made to the owner and he picked up the dogs at our residence, at that time we advised them to get the dogs licensed, they were given dog license applications.
  3. Followed up with apx. 12 residences that had received letters of unlicensed dogs in December. The resident that was home was given 14 days to get the dogs licensed, and the ones that were not home were left applications. We will return on or about February 17, 2011 to check on their progress.
  4. Discussion on giving residents a fee break when they want to go ahead and get the 3 yr license to coincide with their 3-yr rabies shot. After much discussion it was advised that Dog Control officer Sprague, Town Clerk Phoenix and Board Member Backus get together and see what they think would be good for a break and bring it back to March’s meeting.
  5. It was brought up if we need to do a contract renewal with Crescent Pet Lodge. Town Clerk will look into this.
  6. At the time of taking the dogs to the shelter, a question was brought up regarding the town charging an adoption fee for any dogs we have taken to Crescent Pet Lodge that get adopted. After much discussion it was agreed we will not ask for an adoption fee with the thoughts a dog may get adopted faster if there are no fees.

Report- Supervisor

  1. Cold War Vet tax credit- This was discussed in the past and it was found our taxes are low enough now and with another credit it won’t do much.
  2. Steel for Boces – Bill asked Ron if he had any extra steel laying around for the kids at Boces to practice on. Ron stated there are a couple pieces of steel laying at the Highway dept for them to pick up.
  3. Paul Bartholomew’s position with the Board of Assessment Review was up in Oct, 2010. Paul was called and he stated he would continue with the position. On Motion by LaTourette, Seconded by Stuendel it was moved to appoint Paul Bartholomew to the Board of Assessment Vote: All Aye’s Motion Carried.
  4. Michelle, Peggy and Howie are up for Election in November
  5. After meeting with Deb from Ag & Markets, it was pointed out that we should not have a position of Deputy Dog Control Officer, due to the fact that the Deputy would have to go through same inspections as the Dog Control Officer. Deb suggested we contact a surrounding town’s Dog Control Officer to assist us in the case of our Dog Control Officer not being available. After much discussion a motion was made by Stuendel to dissolve the Deputy Dog Control Officer position from Resolution 2011 #3, seconded by LaTourette. Vote: All Aye’s Motion Carried. See Amendment to 2011 #3.
  6. Property owner on the sharp corner on Cemetery Road states he no longer needs cinders put down any farther than corner.

Resolved; on Motion by Stuendel seconded by LaTourette it was moved to designate the National Bank & Trust Co and Wilbur Bank as depositories for all funds held by the supervisor. Other depositories were designated as follows; Justice Backus, Tax Collector Merwin and Town Clerk Phoenix shall use the National Bank of Delaware County for any and all monies they receive by virtue of their offices.

On motion by Layton seconded by Backus, it was moved to NOT attend Annual Meeting in NYC due to high cost of attendance and this was not put in budget. No Delegate assigned.

Planning Board

Assessor

Michelle received Assessor report via email from Joyce Ottens and was read.

Highway Superintendent

  1. Received DPW paperwork on spending Highway funds, Layton will take care of.
  2. Going through the town’s most recent hardcopy of its Subdivision Laws, Ron noted that a) they did not reflect the Oct 20, 2009 amendment to the design standards for new roads in major subdivisions requiring a 4” base of crushed gravel rather than screened gravel, and b) on p54 of his hardcopy, under Drainage, the law reads “Use 18″ min. & larger culverts and shall meet State standards, except that 12″ driveway pipes are required,” and instead of 12”, he says the standard he’s been applying has been 15”.  Carl noted that the law would need to be changed.
  3. Turbo on 2007 International went on Friday January 7th. Warranty did not cover the turbo.  Sam went and got parts in Syracuse and Dana Wagner had it all fixed by Saturday afternoon. Dana is a huge asset for the town, saves money and repair time on equipment. Ron has not received the invoice for repairs but was quoted $3200 – $3300 for parts.
  4. Went through equipment and if he had to get rid of one the first one would be the 88 International
  5. Grit – Went apx. $621 over in grit. Would like board to consider increasing from $5000 in next year’s budget.
  6. Trailer for hauling equipment, planks being replaced and it is being painted.
  7. Doorway complete
  8. Light that was going on and off has been fixed by Marc Layton.
  9. Plowing equipment is ready and being used.

Reports- Dog Control Officer

Brenda Thurston resigned as Dog Control Officer because she no longer had access to a vehicle for the job.  Dog Enumeration and any other issues with dog control will be handed over to new dog control officer Russell Sprague Jr.  Russ Thurston will remain as Deputy Dog Control Officer.

Reports- Supervisor

  1. Dog Control Law – Done and recorded with NY State.
  2. Waste Water Program – Lamont guys have been out talking to residents that will be involved and found that Doris Kinney’s residence was not included, but will be included now.

Reynolds Road – Last two residences on that road will be considered to be added.

A discussion was brought up about who will pay for the electric for the pumps on residence property.

  1. A check for $1840 from the CWC should be coming for the holes that were done by Town Highway employees.
  2. It was found that the town owns tax parcel 227.1-1-31. This will be looked into and discussed at the February meeting.
  3. A Thank you card was received from Sandy Gardepe.
  4. Georgiana Merwin has a tax check for the Town in the amount of apx $50,000.

Public Hearing Subdivision

Public hearing was opened at 7:14PM on the subdivision of Robert Grasso property. No one raised any issues. Motion to Close Public Hearing was at 7:15PM by Buttel, seconded by Stuendel.

Public Hearing on Dog Control and Licensing Law

Public Hearing was open at 7:16PM.

Justice Lloyd Backus raised questions regarding the enumeration status and process, it was explained to Mr. Backus that the enumeration process is not part of the dog licensing law and would be discussed during regular meeting when the dog control officer report is discussed.

Motion to Close Public Hearing at 7:20PM by Buttel, seconded by Stuendel.

On motion by Stuendel, seconded by Buttel, it was moved to approve the minutes of the Board meeting held on November, 9 2010.

The Town’s Financial Statements and Budget Report were reviewed with the Board by Nancy Roberts, Bookkeeper to the Supervisor. Nancy indicated that our final CHIPS reimbursement of $29,000 due this week. The General Fund checking account is a little low, due to having prepaid $33,000 in 2011 expenses for retirement ($23,000 for the Highway Fund) and Delaware County’s charge for planning board assistance.  . A question was raised on the employee count on the drug testing, Ron is checking it out. Question raised on the variance of money spent on grit, Nancy and Ron will verify.

On motion by Stuendel, seconded by Buttel, it was moved to receive, approve and place on file the Supervisor’s financial report.

The Adopted Budged that was signed at the November Board meeting had not reflected the Hancock Fire district numbers. The Bookkeeper presented to the board an updated budget that reflects the numbers for the Hancock Fire District for signing.

Jason Craig – Floor was opened to Jason Craig.

Mr. Craig requested the Town Board to have the Highway Dept. take over the maintenance of Camelot Road.  There are currently 10 residences on the road.  Mr. Craig has an estimate for gravel for the road of $102,000.  Board indicated the cost to the Town is estimated as approximately $65-70,000 per mile; 1 miles is the length of Camelot Road.  The current road status does not meet the Town’s Sub-division or Road Specifications.  Joe Reynolds indicated that he has signed letters from the homeowners indicating the road would not be taken over by the Town but would remain a Private Road.(Note:  Joe indicated after the meeting that he was incorrect in this statement.)  Tim LaTourette indicated the Town had previously met with homeowners explaining that they purchased the property with false impression by Mr. Markey regarding the road status.  Mr. LaTourette also indicated the wires on the road are too low and could not be maintained by Town unless corrected.  It was suggested by Mr. Stuendel for Mr. Craig to review with his attorney in light of the new history of meetings Mr. Craig presented.   Mr. Layton stated he understood the position of the homeowners and Mr. Craig but that the road would have to be brought up to meet the current specifications

Reports-Highway Superintendent

  1. Used 3320 yards of gravel working roads in 2010.
  2. Roads are done being worked until next year.
  3. Headwalls fixed due to last heavy rain on Faulkner, Chamberlain Brook and Pine Swamp.
  4. Personnel list for County was filled out wrong so we got $.75 less for every hour we did for  snow plowing in 2010
  5. Cold patch is done on all roads.
  6. Would like to be able to get concrete pad behind shop done in spring.
  7. Grit, city paid Town ½ of what the town has set aside for grit in 2011.
  8. Road stone on hand, Approx. 150 ton –ST; 60 Ton – 1B; 200 Ton 1A.
  9. Plowing equipment is ready and being used.
  10. Done hauling Grit.
  11. Brush cut on Windfall Rd.
  12. Need to get winter tires for trucks costing $391 a piece. Total Approx. $13,000.  Tires are getting harder to get for the required sizes.
  13. Need to invoice Lamont engineering for 2 (8 hr) days work use of backhoe and one operator.
  14. Rock Rift Road – Seasonal section.  In order to abandon, requires a Hearing with the land owners.
  15. Would like new boom mower, costing 82,524.00.  Ron to make an equipment inventory list with status of condition of equipment and priority for replacement
  16. Chips money. Meeting at Danny’s Restaurant 12-14-10 where Wayne Reynolds will be discussing new regulations on how money can be spent.  Ron will attend.

Reports- Dog Control Officer

Dog Enumeration project was discussed.  Justice Lloyd Backus voiced his concerns in completion of the job in a timely, accurate method.  The Dog Control report indicated 134 residents visited/reviewed; 87 with no dogs, 21 with licensed dogs and 23 with unlicensed dogs.  Verbal warnings were issued with letters to be mailed from Town Clerk.  Brenda indicated she was going to have to work with Private Communities to obtain enumeration counts.

  1. Town Clerk Appointment to Michelle Phoenix.  As newly appointed Town Clerk, Michelle has started her training with Gail Crane.  Michelle is on a 60 day probation period.

Resolution 9-2010 for the adoption of Local Law 1-2010 was signed by the Board.

  1. Question raised regarding whether or not the letterhead should reflect the web address. Decision was made that letterhead should show the Town Of Tompkins web address.
  2. The status of the Town Shed entrance way – Bill has an estimate of $1350 with $675 down and balance on completion of Job, estimate includes labor and material by contractor Len Warner.  On motion by Buttel, Seconded by LaTourette, it was moved to accept the estimate and to go ahead with job.
  3. Generator at Town Shed – This requires a building permit, installation of circuit breaker by licensed electrician and then inspection by a licensed electrical inspector.  Joe will create the permit, Bill will sign it and contact the electrician, Hank Raymond.

Correspondence

Stream Corridor Management Grant program meeting will be held on December 16, 2010 at 11:00am. Carl stated that the County Planning Board will assist the town by filling out most of the grant application paperwork, once town representative, Ron V. and Howie B., have identified areas needing attention.

Questions raised by Amy Hawk –

  1. Would like clarification of why the projected property tax for 2010 is blank and shows up as a negative figure down below.   Nancy Roberts explained the negative below is the projected assessment and will be moved up once the budget is approved.
  2. Where do we get actual expenditures from 2010 to put into the preliminary budget?  Again Nancy Roberts explained the numbers are obtained from the monthly financial reports which are available in the Town Clerk’s Office.

The Town’s Financial Statements and Budget Report were reviewed with the Board by Nancy Roberts, Bookkeeper to the Supervisor.  Noteables – A partial payment CHIPS money that had been applied for in August was received; Received projected 2012 retirement figures showing an increase of $33K to $49K.   All need to be aware of the ongoing increases in costs.

Visitor Questions –

Craig Fritzsch – Question regarding the status of the burned out crane.  Mr. Fritzsch would be willing to give the town $1000. for equipment.  Bill Layton responded that the equipment had been sold by the company to India and the company that owns the crane is in process of removing it.  Work on the physical removal had started earlier this week.  Was decided this was a moot issue at this time.

Reports-Superintendent – Ron VanValkenburg

Dryden-Gray Rd. – replaces 3’ pipe with 5’x40’ squash and collar – cost $4150 plus headwall stone.  A question was raised by Stuendel as to whether or not Stream Mgnt would pay for any of this work.

Faulkner Rd – headwall on discharge end fell over during the flood.  Repair scheduled for Thursday

Rain storm – have been doing repairs to roads and have cut up and removed fallen trees

Carcass Brook – worked the road and cut the bank back.  Made ditch deeper. Used 50 loads gravel

Shop – Have performed a lot of truck repairs and changing tires.  Dana Wagner has been welding supports under boxes

Concrete for addition Town Hall has been poured and finished.

Violation – The Building Inspector has issued a violation on pole barn exit.  A roof is needed as there is a danger to personnel as the snow/ice freezes the door and entry way.

On motion by LaTourette, seconded by Backus, it was moved to resolve/correct the building violation.

Emergency Assessment Form – Bill Layton asks Ron if the form was completed for the flood damages on 9-30-2010 and 10-1-2010.  Ron responded that he faxed the day after the flood that minimum damage resulted with and estimated cost of $33,000 not including labor and equipment usage and cost.

Concrete pad in back of shop – Last year’s estimated price was $6,680.  Ron questioned if this is to be completed now.  The pad would make the washing of trucks cleaner and safer for the personnel as the area becomes very muddy and slippery.  Discussion ensued as to where the money would come from.  Town is awaiting response on the Court Bldg. Fund Grant Application. Bill will follow up on the status of the grant.

Reports- Planning Board – James Fox

No report submitted.  The Board asked Sandy to contact James Fox and request a report for the last few months and impress on him the importance of timely reports.

Reports – Assessor – Joyce Ottens

Bill Layton indicated the reports for September had been mailed to Town and received the day after last month’s meeting.  The report for October meeting was received.  Bill read both reports which seemed to be basically the same.  Bill Layton is going to follow up on court case and to make sure that she include in her reports any communication with attorney Robert Bebe, who represents Town of Tompkins in its ongoing struggle with NYC over tax assessments.

Reports – Dog Control Officer – Brenda Thurston

New monthly report format – Gail Crane presented the new monthly report that Brenda, Sandy and she had created.  In summary, there were 7 complaints/assistance requests from homeowners; 2 dogs removed to the shelter, no dogs relocated.   Bill Layton indicated he thought it was too detailed, Carl Stuendel indicated he liked seeing the detail.  Bill requested that the detailed report be emailed to the Board prior to the monthly meeting.

Enumeration project status – a 911 worksheet by street has been generated and the Dog Control Officer has begun visiting each location to count the dogs.   During this process a number of dogs in violation have been found.  Discussion ensued as to whether or not the violations should be addressed at the time of the violation being discovered – or after the entire enumeration project completed.    Suggested process by Dog Control Officer is –

Step  1.  Verbal warning, at time of violation discovery during enumeration visit

Step  2.  A letter from the Town Clerk indicating violation discovered and license/rabies vaccination required within 30 days.

Step  3.  Follow up by Dog Control Officer 30 days after letter sent.  Issuance of summons if the violation had not been corrected.

Database status – As required by the State, Dog Licenses for renewals and control will be turned over to the Town to administer effective January 1, 2011.  Renewal notices, tags, etc.     Establishment of an accurate database of current dogs is in the process. As reported last month 188 letters to all previously licensed dogs that were past due were sent out.  A good response has been had with the database being updated from the returned letters where the dog owners have indicated the dog is deceased or been moved.

The process that has been established at this time is:

Step 1 – Create the database from all previously issued dog licenses on file in Town Clerk’s office.  COMPLETE

Step 2 – Send a letter to ALL previous dog owners where dog license is past due for renewal.  COMPLETE 188 letters sent

Step 3 – Dog Control Officer to follow-up on review of the database

Step 4 – Dog Control Officer to issue corrective action for un-licensed dogs.

A discussion ensued on the pros/cons of the enumeration and dog licenses database issues.

During the process of reviewing the returned notices, there is an instance where a dog has been reported as deceased dog but the Dog Control Officer knows the dog is alive and is in violation of license.   During the discussion, Gail raised the question of legal liabilities of the Town’s enforcement or lack of enforcement regarding rabies vaccinations.  Can the Town be sued if a dog has not had the rabies shot as required, and by chance bites a person or if the dog is not holding a current license?  A discussion of pros/cons ensued.

Further discussion ensued on the license renewal process.  Should all licenses be renewed in June or on anniversary date.   Sandy indicated the annual renewal in June was not working.   Gail indicated the system is all set to generate automatic renewal notices.   Gail also indicated that her understanding at the last Delaware Town Clerks Association meeting that most towns were renewing based on anniversary date.  Bill asked that the Town Clerk contact various towns again to confirm their  renewal process.  We agreed to table a decision regarding dog license renewal dates until next meeting when we would have more information on whether the town might be able to provide a rabies clinic three times a year.

On motion by Stuendel, seconded by LaTourette, it was moved to pursue corrective action on all violations discovered as a result of the enumeration or database review process.

Dog Rabies & Spay Neuter Clinic – Brenda has been working with the vet Dr. Pritze on trying to establish a rabies clinic.  Dr. Pritze gets .50/mile.  It is believed that fund raising or donations is legal to help support this.  Brenda requests permission to hold a couple of fund raising events – Bake Sale and Penny Social in support of a rabies clinic.  Rabies clinics are currently held at various times throughout the county by the Delaware County Public Health Dept.

On motion by Stuendel, seconded by Buttel, it was moved to allow Brenda to hold a fund raiser.

Resolution on Cannonsville Cemetery – Resolution # 10 for transferring the Cannonsville Cemetery from the Cannonsville Cemetery Association to the Town of Tompkins was reviewed and signed by the Board.

Grant Stream Mgmt Program – project clarification Rt 206 and Trout Creek stream needs refining.  The County has offered their assistance in reviewing and correcting the grant application process.

Correspondence – Bill Layton

Letter of resignation effective November 1, 2010 has been received from Sandra Gardepe, Town Clerk due to health reasons.  The current Deputy Town Clerk, Gail Crane, was asked if she would be able and willing to take on the job for the next few months or year.  This is an appointed position.  Gail indicated she was willing to assist until a new Town Clerk can be appointed or elected.  The flexibility of time for Gail is a concern as she travels out of state quite often.  Gail is willing to work with a replacement person to teach or assist where possible.

On motion by LaTourette, seconded by Stuendel, it was moved to table the acceptance of the resignation at this time.

Budget

The tentative budget as established be previous meeting was reviewed and discussed.  There had been no changes since the previous budget review meeting of September.  Concern was voiced by Tim LaTourette regarding the Highway personnel budgeted amounts and lack of replacement personnel budget.  Discussion of where funds would come from if and when replacement personnel is determined to be needed as it is not spelled out in the current budget.

On motion by Layton, seconded by Stuendel, it was moved accept preliminary budget and bring before a public hearing.

4. Readburn Mt. – working on the road, aware it is a bit slimy. Have had no complaints. Ditching, cut brush. Will cut more before winter. Changed 5 pipes
5. Have question on the snow plow contracts with the county – what is the expiration date. Bill thought they were good for 3 more years. Bill will get a copy for Ron.
6. International truck – Needs dyno testing. Milton Cat does not have tools needed to test. The truck seems to be losing power on the hills. Problem has been for over a year, truck has 80K miles on it now. Bill indicates money is low but we should get a quote before work is performed. Board agrees that we need to get it on record with CAT that problems exist before warranty expires. Ron to validate paperwork on truck regarding warranty.
7. The D6 bulldozer – very old machine – parts are falling of. Tracks and brackets are worn out. Estimate of over $12,000 for parts, not including labor, for repairs. The machine is used only during floods, then needed a lot, otherwise it has minimal use. Question is – Do we fix it or not? Bill Layton will bring up in Budget meeting.

Reports – Dog Control Officer – Brenda Thurston

Gail Crane gave an update on the new dog license database created. The database currently has a count of 345 dogs. Of this 345 dogs, 188 dogs are past due for license, 93 dogs are deceased or no longer valid, 64 dogs have valid licenses. Letters have been prepared and will be mailed this week to the dog owners of past due licenses. Brenda Thurston will follow up with any past due license with no response to the Town Clerk’s office.

In regards to the Dog Enumeration Program, Gail Crane has received and prepared a listing of all addresses by Street Name for Brenda to use as a worksheet.

Gail Crane has created a Summary Dog Control Monthly Report form for Brenda to use monthly in reporting to the Board. This will be used in conjunction with the current Enumeration Sheet and Trouble Call Sheet.

Job Description is required for the Dog Control Officer. There may be one already in the Town Book. Bill requests to have Sandy look up any existing job description. Actually, a job description for all employees of the Town should be established.

1. West Branch Delaware River Stream AKA Delaware Watershed Stream Mgnt Program Grant – 57 projects Watershed, 10 high priority, 3 medium priority
Town got accepted for 1 grant – small project for taking trees out of creek.
Bill said this was a very good learning experience and will prepare us for future applications. Town can submit another grant application in October. Contacts – Ron is primary and Butttel is the secondary. Ron/Howie are to attend meetings and give voice. During discussion of this topic, Ron brought this item to the board’s attention: Agreement — Ron gave gravel to state from putting stream back and is supposed to receive grindings from the state highway.
2. Cannonsville Cemetery – We have a person (Sandy Jewel) who is interested in purchasing plot and burying her husband. There are many unresolved questions and procedures to be established. Question raised as to what other Towns do. It was decided to have Sandy Gardepe contact various towns for copies of their procedures and to contact Normal Carlson to find out who did the burials and grave digging. Also to find out which is the latest maps and current pricing on plots. All agree that responsibilities need to be established and procedures developed.
3. BOCES – addition to building. Ground was broke today for the addition. Footing is done. Want to make sure a timely schedule is adhered to. Also want to make sure the invoices for the addition from Jess Howes are on a separate statement.
4. Dog Licenses – effective January 2011 Town is required to take over the dog licensing issues. Budget lines need to be established for this additional expense. Gail/Sandy have been at work setting up a dog database. New town ordinance is required to be established and a public meeting will be required. There is supposed to be a transitional worksheet of info being sent in the near future to assist to setting this all up.
5. Budget items for the future – Electronic file system of sub-division laws, resolutions, local laws, etc. need to be setup on the computer and availability to the public set up on our website. Legislation is required for dog licenses. Public hearings – no changes without a public hearing
6. Kingswood – Hathaway Pond – want to establish 5-6 permanent campsites to be used by church functions. Will not house permanent trailers but travel trailers that would come and go based on various church functions. Sewer system permits have already been granted. Joe Reynolds submitted a question of what type of permit and fee is required. Ron noted that any change to driveway or road entrance may require a site plan review. Just in case roads are damaged. Would a resolution and public hearing be required for establishing a campground? Board needs to look more into this matter. Health issues checked OK. Bill will get more information and call the board members.
7. Trout Creek signs – Letter received from Hannah Wagner regarding construction of “Welcome to Trout Creek” signs. Discussion that state lands may require permission from state. Peggy volunteered to shop around for sign prices.
8. Culvert for snowmobilers on Bridge Street. May be either a bridge or a pipe. If snowmobilers purchase the pipe the town can put it in – must be at least 20 foot long. Motion was made by Peggy, seconded by Carl for the snowmobilers to purchase the pipe and the town to do the installation. Vote: All AYEs – Motion carried.
9. Discussion regarding speed limit in Trout Creek. Previous letters submitted to the state attempting to get speed reduced was unsuccessful. Board suggest perhaps a petition would be able to get established and submitted to the state. Board can contact the Sheriff’s Dept. and request speed to be monitored. Bill will contact the Sheriff’s Dept.
10. Budget – Nancy has prepared tentative budgets that are ready for review. Budget meeting date Thursday, 9-16-2010 7:00 PM set up.
11. Town of Tompkins state retirement payment has increased by 30% over last year’s amount.
12. New Oath of Office cards for Howie and Peggy need to be obtained for 2011. Sandy to obtain new cards.

Reports – Superintendent

  1. Pat Hanley gets $63 per hour for repairs. This was in answer to the question about the bill on the 1995 Chevy.
  2. Work done- changed pipes, cut brush, did repairs, weed eating, and painted posts.
  3. Next week (19th) will be putting down 2 inches of pug mill mix on S Dry Brook Rd should take 2 days.
  4. Helped Masonville put down pug mill mix 7-12-2010.
  5. Readburn Rd ditching, cutting trees and brush.
  6. Put down gravel on Alger Rd, Carroll Hill Rd, Beers Rd, and Fletcher Hollow Rd.
  7. Took out a gravel bar by the bridge on Carroll Hill Rd.
  8. 3 Trucks went to Hanley’s to fix the AC. Broom AC needs fixing. Massey new clutch and bearings.
  9. Worked on Lookout Rd. Widened the entrance from Herrick Hollow Rd, took out a stone wall for better vision. Took out trees and made the turn around bigger and put down gravel.
  10. Put all brand new pipes on Lookout rd.
  11. The Superintendent will take the old computer over to the Hwy Department. We will check to see if there is a wireless connection available.

Dog Control Officer – Brenda Thurston spoke about the over population of dogs. The Delhi Shelter gave us some vouchers for spay and neutering. Need to have some fund raisers for more of the vouchers .Brenda needs permission from the Board to hold the fund raisers.  On motion by LaTourette seconded by Stuendel it was moved to give Brenda permission to hold the fund raisers for additional vouchers for spay and neutering.    Vote: All AYEs       Motion carried.

The money that is raised goes to the Delhi Shelter and they give out the vouchers.

On motion by Stuendel seconded by Layton it was moved to advance to Brenda up to $200 for gas for enumeration and trouble calls if necessary. Brenda will begin using a form for Enumeration and Trouble Calls and will turn in a monthly report.

Reports – Supervisor

  1. The Town’s Financial Statements and Budget Report were reviewed with the Board by Nancy Roberts, Bookkeeper to the Supervisor.  June Bank statements were not available as of now. There are potential shortfalls in Highway Dept income from Delaware County and NY City of an estimated $20,000 due to less snow plowing during the winter.  Potential budget overrun in Highway Equipment Repair.     On motion by Backus, seconded by LaTourette, it was moved to receive, approve and place on file the Supervisor’s report.   Vote: All AYEs – Motion carried.
  2. Grant for the new addition- The Court Clerk gave the Supervisor a letter about a grant that the Town can apply for the new addition and courtroom equipment.  Court Clerk Lynne Carlstrom will do the paperwork for the grant when it becomes available.  On motion by Stuendel seconded by Layton it was moved to file for a grant from the Justice Department for new addition and courtroom equipment when it becomes available.    Vote: All AYEs       Motion carried
  3. Walton Fair Board sent a thank you letter to the Town for our donation towards the new horse barn.
  4. Teague land- the owner paid the taxes owed.
  5. The Supervisor told Mr. Wagner about what the Assessors said at our special meeting.
  6. On motion by Backus seconded by Stuendel it was moved to pay Charles Koehler $25 for trying to serve a summons.    Vote: All AYEs            Motion carried.
  7. Correspondence – None
  8. The summons on the property (tax map #227.1-1-11) that Mr. Koehler attempted to serve was discussed at length by the Board.

On motion by Backus seconded   by LaTourette   it was moved to approve the Abstract of Claims for July 12, 2010 as follows:       General Fund: $ 4,933.95        Highway Fund:$23,012.82
