The regular monthly meeting of the Town of Tompkins Town Board was called to order at 7:00 pm in the Town meeting room, Trout Creek, NY. With William Layton leading in the Flag salute.

Opening of Stone crushing bids-
Clark – $3 per ton
Northern Crushing LLC – $2.90 per ton

On motion by Buttel, seconded by Albanese to accept the low bid of $2.90 from Northern Crushing LLC.

Guest Speakers:
Carl Stuendel – Carl advised the board he would no longer be running the website after December 2014 – Carl stated he had received an interest from another resident of the Town some time back but has not heard any more from them. After much discussion Brian Albanese agreed to post the minutes on the website via linking the minutes that have already been wrote up by Michelle in a PDF format. Brian and Carl agreed to meet and discuss the process.
Scott Piesecki and James Hutton – Stated they were here to follow up and advise the Board on their findings with the Hancock Transfer station.

On motion by LaTourette, Seconded by Buttel, it was moved to approve the minutes from the Public Hearing for the 2015 Budget held on November 6, 2014

Highway Superintendent –
- When Ron and the guys arrived on Thanksgiving morning as they opened the door to the shop they noticed the building was filled with smoke, Upon investigating they found that one of the trucks had caught on fire around the battery box but had luckily burned its self out. Ron contacted the simplex and had them come out and check the system and it was found that it had failed. They repaired what they could and we have received a bill for $3200.
- Bill had contacted fye-fyter a fire alarm system company they come and checked the system and stated it would cost apx $1000 to get the system up and running properly. – The board will discuss on what should be done and review options for a new or repaired system.
- Ron will be purchasing 16 tires.
- Repairs have been done on various trucks.
- Ron asked the board if he could get another phone line in the shop for a dedicated fax line. Bill stated he will look it to the cost.
Dog Control Officer – None
Supervisor –
- Applied for a grant through the CWC for the Storm water retrofit in the amount of $24,054.41 for operation and maintenance of stormwater. This is a onetime grant and the funds must last 20years. It was discussed that someone will need to be hired after further discussion it was tabled until next month.
- Michelle had received an anonymous call from someone upset with Ron and the personal use of the Town Trucks. The Board discussed this issue with Ron
- On motion by LaTourette, Seconded by Buttel, To approve Resolution 12 – 2014 stating that the Town of Tompkins Town Board herewith provides written consent for the abandonment of a portion of Rock Rift Mountain Road extending from a point in said Rock Rift Mountain Road, said point being 1.1± miles north along the said Rock Rift Mountain Road from its intersection with Readburn Road and being further described as the northern most intersection of the Rock Rift Mountain Road with the southwesterly property line of the Sal and Michael Calabrese property (tax map number 354.-1-7) as it exists in 2014, northerly through the premises of Sal and Michael Calabrese, Gertrude Trask, Phyllis Schiippel and Linda Trask, Rock Rift LLC, and Starlight Forests LLC, to its current northern terminus at Readburn Road.

Other:
Hancock Transfer Station – James Hutton and Scott Piesecki stated they have done some investigating on this issue and it seems that the Transfer station is unorganized. They had gone there many times and observed many people coming in without tags and nothing is done about it. They also observed that Truck loads of garbage were coming in and just dumping the garbage in one big pile and there was no separation of recyclables. They noted that one pickup truck that had a very large load one day dumped and then was there again two days later with the same amount of garbage, Scott stated this could not have been one residents garbage for a week. Scott also stated he had went to the Town of Hancock and went through the list of people that had purchased tags and was pretty sure that all that dump at the transfer station were not on the list for purchasing tags.
Brian Albanese stated that it sounds like the town of Hancock has to be more responsible of a better policy for the tag purchasing and the policing of such at the transfer stating. Brian felt that we should contact the Town of Hancock and advise them we are paying X amount of dollars and it is their responsibility to fix their issues and policing of the tags and their facility. Brian suggested they can charge the Town of Tompkins residents a $10 fee and the Town of Hancock be responsible for collecting this and the employees of the Transfer station enforcing that only those with tags.
The Board agreed it would be beneficial to hold a meeting with the Town of Hancock Supervisor and all other interested parties.
Creamery Purchase – The Board discussed the purchase of the creamery from the sewer district, so that it can continue to be used for cold storage for the town equipment. Bill will contact CWC with questions.
The board discussed once again to set up a meeting with the Hancock Rural Fire District Commissioners. Bill, Michelle and Luther Higley have all tried to find out who is in charge of the Fire District budget, when they call the Town of Hancock they are told to call the Village, when they contact the Village they are told to contact the Town. Luther has tried numerous times to find out who exactly are their commissioners and has yet to get an answer, between Luther, Bill and Michelle and the attempts to get these answers they are all told from the Village and Town that no one knows who the fire commissioners are. Michelle contacted the Hancock Fire chief and he stated who he thought they were but was not totally sure and that he thought they were down 2 commissioners. Luther has also been told that the commissioners will no longer be holding meetings for 2014, but when he contacted someone else about the issue he was told they are having a meeting this month. Then he received word that that meeting was going to be canceled. After much more discussion about this issue, while Bill attempts to set up a meeting with the Town of Hancock for the Transfer stations issues he will also try and get a meeting set up at the same time to involve the Hancock Rural fire district commissioners, And any village/Town employees. Bill contacted Christa Schafer – Clerk for the Del Co Board of Supervisors and she had stated she received the Hancock rural fire district budget from the Village of Hancock.
Sewer District:
On motion by LaTourette, Seconded by Albanese to approve the Abstract of Claims for December 8, 2014 for the sewer district in the amount of $5526.13

The November sewer district worker report was provided for the board to review.
Michelle advised the board the need to get the snow plowing and shoveling done for the driveways and entryways to the pump stations. The Board agreed to put the bids out in the paper. On December 29th Michelle will open the bids and scan and send them to the Board via email. Via Email the board will motion on their acceptance of the winning bid.
On motion by Albanese, Seconded by Layton to renew the Administrative agreement between Michelle and the Town to run from January 1, 2015 – December 31, 2015

The regular monthly meeting of the Town of Tompkins Town Board was called to order at 7:08 pm in the Town meeting room, Trout Creek, NY. With Brian Albanese leading in the Flag salute.

Guest Speakers:
Many residents of the Kelsey, Apex , Roods Creek and Chamberlin Brook area approached the board questioning the board’s decision on not paying for the 2015 Hancock Transfer station fees. After much discussion a committee of community members was formed of the following residents, Monica Tariantino, Pat Winners and Louanne Berg. The committee will investigate and bring back to the board as to how many Town residents garbage is picked up by haulers and haul to the transfer station and as to how many permits were given to Town of Tompkins residents for the use of the transfer station. When this and other information is received the Board will take into consideration the concerns and try to come up with a resolution to solve the issue.
Faruq Baqi – Questioned the board on how to get Roods Creek Road paved. The superintendant and Board explained the cost of having this done and also explained that due to the heavy trucks that the road road on a daily basis that all work that would be put into the road would just get destroyed.

Other Reports:
Planning Board – Bill stated that Paul approached him and stated that the Planning Board will not have monthly meetings if they have no business on the schedule.
Assessor – Wendy stated she had heard that her responsibility as an Assessor to draw fire district lines. Wendy stated this was not true and provided the Board with the Laws that involve this subject.
Highway Superintendent –
- Received a grant for 50,000 from State & Municipal Facilities Capital Program through Bonacic’s office for the purchase of a building to store the town highway equipment.
- Ron discussed with the board the need to have gravel crushed. The board agreed to allow requests for bids to be put out. All bids will be read at December’s meeting.
- Did some shoulder work
- Repaired some roads with holes in them with cold patch.
- Stored summer equipment in Creamery.
- All of the grit has been hauled with some other Towns helping in hauling
- Have done some repairs on trucks
- Helped Franklin haul gravel in repayment for their help with us.
- All trucks are ready for the winter snow season
- The seasonal road closure needs to be posted in the paper along with the Friendly reminder.
- Bill checked into the cost of using a company out of PA to get grit from and found it would end up costing more then what we pay now.
Dog Control Officer – Received one call this month
Supervisor –
- Received from Christa Shafer the amount that will be collected by Tompkins Tax Collector from the taxpayers on the other side of the reservoir 2015 Town and County Tax bills and will be paid to Hancock Fire District in the amount of approximately 24,000, this has went up about $5000 from last year.
- Rock Rift Road Closure – On motion by Buttel, Seconded by LaTourette it was moved to approve a 100% abandonment of Rock Rift – Vote All Ayes – Motion Carried
- Bill provided a new form to be filled purchase request form to be filled out for any items purchased over $1000.00.
- The Union Contract paperwork has been completed. On Motion by Layton, Seconded by LaTourette it was moved to approved contract and send off to Union Rep, Roberta Dunker, Vote – All Ayes – Motion Carried.
Correspondence: Received a request for donation by the Delaware County Historical Society. On Motion by Layton, Seconded by Albanese to give the society a donation of $75.00, Vote – All Ayes, Motion Carried.

On Motion by LaTourette, Seconded by Buttel to accept the Preliminary Budget with said changes and to make it the Final Budget. Vote – All Ayes – Motion Carried.
Sewer District:
On motion by LaTourette, Seconded by Backus to approve the Abstract of Claims for November 6, 2014 for the sewer district in the amount of $1585.79
Vote – Ayes – Buttel, LaTourette, Backus, Abstain – Albanese, Layton. Motion Carried.
This amount excludes payment to LVDV.
A monthly report was provided to the board by LVDV.
Michelle provided the board with a budget made up by LVDV and K. Young’s office. The board felt there was not enough information on the budget to approve it at this time. Michelle will contact LVDV and K Young’s office again and get unanswered questions answered and bring it back to December’s meeting.
Michelle Provided the Board with the Updated Emergency Response Plan – Upon Reviewing, On Motion by Albanese, Seconded by Layton to approve the ERP provided.

Assessor – None
Highway Superintendent –
- Received $1996 in money for scrap metal.
- Working roads
- Various loads of gravel have been put on roads.
- All gravel from gravel bank has been hauled over to gravel pile.
- Approximately have 50 loads left to crush and Ron asked if there was money to have this done.
- All working of roads for 2014 has been completed.
- Some repairs have been done on trucks
- Ron stated that grit may be used this year with the salt for the County Roads.
Dog Control Officer – None
Supervisor –
- Our bill for the use of the Transfer Station in Hancock for Town of Tompkins residents in prior years has been $2200. This year we had received a bill for $5000. Bill had looked into this and had been told that only 68 residents of Tompkins had used the transfer station. On motion by Albanese to cease participation in the use of the Hancock transfer station due to rate increase for all Town of Tompkins residents, Seconded by Backus. Vote: All Ayes
- Closure of Rock Rift Road – Bill is going to contact Wayne Reynolds and discuss steps on doing a total abandonment or a 90 – 10 split.
- Discussion took place on the issue with the fire district coverage between Hancock and Tompkins. Bill will contact Luther Higley to discuss this again.

Other:
The Board reviewed and discussed figures on the Tentative budget for 2015. On motion by Layton, seconded by Buttel to accept the tentative budget tonight with discussed changes and make it the preliminary budget.

Sewer District:
On motion by Albanese, Seconded by Layton it was moved to approve and for the supervisor to sign pay application #18.

There has been a walkthrough of the sewer district and a punch list has been compiled of items that needed to be complete before final payment can be made. After all items on the punch list are completed and are satisfactory Lamont will approve final payment. Lawn settlement will be exempt from this punch list and will be again reviewed in the spring of 2015.
Resolution 11-2014
On motion by Backus to authorize the sewer use assessment to be included on the real property tax bills and authorizing the Town Clerk to file the 2015 sewer rates of the Trout Creek Sewer District with Delaware County, 2nd by Buttel

Guest Speakers:
Rick Roberts, The Finger Lakes Trail coordinator for our area, Mr. Roberts was here to discuss the hiking trail that is in our area named “The Rock Rift Rail Trail”. Rick explained that a new marked portion of the trail goes from St Rt. 10 to the Rock Rift Fire Tower and back to St Rt. 10. Mr. Roberts provided maps and pamphlets for anyone interested.

On motion by LaTourette, seconded by Buttel, it was moved to approve the minutes of the regular board meeting held on July 14, 2014 and the special meeting held July 17, 2014

Planning Board – None
Assessor – Provided. Wendy was also here to explain the States equalization rates and how it will affect tax bills.
Highway Superintendent –
- 3/10 of a mile on Chase Brook was torn up and approximately 80 loads of Gravel and Mag Chloride have been put down.
- Helped the Towns of Deposit, Franklin and Walton.
- Cut brush on Carrol Hill.
- Finished stoning and oiling.
- Received money for scrap.
- We were turn down for the grant through the State & Municipal Facilities Capital Program. Next year we will try again and see if you can get money to purchase a storage building of some sort.
Dog Control Officer –
- Received a call from NYSEG about one of the linemen getting bit by a dog on Lower Loomis. The dog has been identified and Russ has supplied NYSEG with the rabies paperwork on said dog.
- Received a call from an investigator from Delaware County requesting any information the Town may have on the 2 Huskies that had been killed for the upcoming court case.
- Talked to Linda the Court Clerk, her and DCO have come up with an agreement on the summons process for unlicensed dogs.
Supervisor –
Bill brought up the Towns website and if there was a desire to keep it. Nancy Roberts stated that Carl would continue to put the Town minutes on the site and charge the Town $50.00 a month. The Board made no decision on keeping the website or not.
Correspondence:
Received an anonymous letter from residence on Tower Mountain stating that there was a person that has Fresh eggs sales. The complainant stated when they had purchasing their property it stated that there is a stipulation restricting this type of endeavor and they would like the Town to put a stop to sales of fresh eggs.
Other:
- A discussion took place about transactions taking place in the Town of Tompkins and that a receipt should be given for any and all transactions taking place with any official of the Town of Tompkins – See Resolution 10- 2014.
- The Board reviewed and discussed figures on the Tentative budget for 2015.
Sewer District:
- On motion by Buttel, Seconded by LaTourette it was moved to approve and for the supervisor to sign pay application #17 upon receiving official signed copies from Lamont.
Vote – All Ayes - On motion by Backus, Seconded by LaTourette to approve the Abstract of Claims for August 19, 2014 for the sewer district in the amount of $817.94.
Vote – All Ayes - The Court Room office will now be used by the Sewer District operators they were given a key to the Town building so they have access to their office.

On motion by Buttel, seconded by LaTourette, it was moved to approve the Abstract of Claims for September 8, 2014 as follows:

The regular monthly meeting of the Town of Tompkins Town Board was called to order at 7:00 pm in the Town meeting room, Trout Creek, NY. With Tim LaTourette leading in the Flag salute.

Minutes Approval:
On motion by LaTourette, seconded by Buttel, it was moved to approve the minutes of the regular board meeting held on July 14, 2014 and the special meeting held July 17,2014

Monthly Financial Reports:
Town Clerk:
On motion by Buttel, seconded by Backus, it was moved to receive, approve and place on file the Town Clerk monthly report for July 2014.
Vote: All AYEs – Motion carried.
Supervisor’s Report:
On motion by Backus, seconded by LaTourette, it was moved to approve and place on file the supervisor’s financial report, dated July 31, 2014.

Planning Board – None
Assessor – None
Highway Superintendent
- 2 inch has been done on Windfall and Dry Brook Road. Also did portions of Bobs Brook and Dryden Road.
- More Ditch work, Boom mowing, and Cold Patch has been done on various roads. Also have hauled more gravel.
- Summer help has been weed eating, painted the picnic table by the school house and have washed and painted the fuel bay.
- Scotts 10 wheeler is at cat getting the turbo fixed
- Sam’s truck has had the rear suspensions rubber blocks replaced.
- Turbo lines on one of the 2006 have been changed
- The A/C on the Excavator needed recharging and the only place to get it done was in Binghamton.
- Noticed that some roads this past year have gotten low spots and have been repaired.
- 3/10 of a mile on road by Rainbow is getting repaired.
- Ron requested looking into purchasing an Athey Machine for shoulder work on roads.
- Dealing with some issues with FEMA for the rain event that damaged Carrol Hill Road.
Report – Dog Control Officer –
- Received 3 dog calls all have been resolved.
Report- Supervisor
- Tentative Budget will be worked on and turned into the Clerk’s office by 9/30/14.
- Ogden reality will be used for putting the creamery on the market.
- Public hearing is set for September 8, 2014 for abandonment of a portion of Rock Rift Mountain road.
- A lengthy discussion took place on the procedure with the Court when it comes to unlicensed dogs. The DCO will contact the court to discuss the way they would like tickets wrote out.
- From here on out all Sub contractors will have to sign a hold harmless release and an Independent contractor statement.
- Mr. Engleman from BOCES Science class will be in the stream behind the stone pile on 206 to do sampling.
- Discussion took place on if the Highway crew would be interested in plowing and shoveling around the pump stations for the winter season. Ron will think about it and let the board know.
- Bill showed the board a letter for Roberta Dunker with the agreement from negotiations meeting held 8/17/14. The board agreed with the letter and agreed to have it sent off to Roberta.
Correspondence: – Received a letter from NYMER stating they have applied for a rate Decrease.
Other – There will be a sewer district informational meeting held at the Town building for any residence on the system to be held September 11, 2011 at 7:00 PM
Sewer District:
On motion by Albanese, Seconded by Layton it was moved to approve and for the supervisor to sign pay application #16.

On motion by LaTourette, Seconded by Backus to approve the Abstract of Claims for August 19, 2014 for the sewer district in the amount of $1575.64

The invoice received by Ben Reynolds Construction in the amount of $8,200.00 has been paid and the work has been done at the fire hall.

On motion by Backus, seconded by LaTourette, it was moved to approve the Abstract of Claims for August 19, 2014 as follows:
General Fund: $5270.93
Highway Fund: $15,388.88

Opening of mowing bids for sewer district/award:
Received 3 bids.
On motion by LaTourette, seconded by Buttel, it was moved to accept lowest bid of $599 per mow from Luther Higley J.R.

Mr. Higley will need to sign a Hold Harmless agreement prior to work being started.
Minutes Approval:
On motion by Buttel, seconded by Backus, it was moved to approve the minutes of the regular board meeting held on June 9, 2014.

Monthly Financial Reports:
Town Clerk –
On motion by Backus, seconded by Buttel, it was moved to receive, approve and place on file the Town Clerk monthly report for June 2014.

Supervisor –
On motion by Albanese, seconded by Buttel, it was moved to approve and place on file the supervisor’s financial report, dated July 14, 2014.

Other Reports:
Planning Board – None
Assessor – July 2014 Monthly report was provided for Board to review.
Highway Superintendent –
- Some roads have received cold patch.
- Magnesium Chloride has been put on all dirt roads and extra was put on in front of homes.
- Windfall and Dry Brook are ready to have 2 inch put on. There may a delay on Windfall due to clear cutting of pines being done on a property on the road. Ron doesn’t want the equipment to damage the new stone.
- Damage from recent storm was minimal with exception of [Carcass Brook and Carroll Hill].
- Preparation and cutting back brush has been done on the road from Rainbow lodge to city property to prepare it to get redone.
- Summer help has been weed eating, washed outside of Town building, Stained deck at Kelsey house.
- 2.6 miles on Dryden Rd needs to be resealed.
- Next year Ron would like to seal roads, Depending on funds received from CHIPS. They have gotten behind with the sealing of roads. Ron estimates the cost to be someone where around $16,000 – $17,000.
- Ron requested the summer help to be able to continue to work an addition 3.5 weeks. On motion by LaTourette, Seconded by Backus to approve an addition 3.5 weeks of work for the summer help. Vote: All AYEs – Motion carried.
- Ron discussed with the Board the need for an additional Employee; Ron stated things are getting behind because of not having enough men to finish jobs.
Dog Control Officer –
- Received [two] calls this past month.
- There keeps being an issue with the same dog on Dryden being picked up and taken to the pound.
- Received a call about a missing pit bull / lab mix – Dog was found by someone in Walton.
- Received the HCHS 2014-2015 contract – Michelle will call them about unanswered questions.
Supervisor –
- Received an agreement from CWC for the Town of Tompkins to sign for reimbursement of fees, and expenses of professional consultants and/or attorneys retained by the Town to review, analyze and/or assist in the administration of real property taxes paid by NYC or City-owned land up to Four Thousand Four Hundred Dollars$4,400.00 On motion by Albanese, seconded by LaTourette, to make said agreement Resolution 9-2014 and have William Layton sign and to act on behalf of The Town of Tompkins. Vote: All AYEs – Motion Carried.
- Flood committee meeting is set up for Tuesday July 15th 2014.
- A Grant has been applied for to help purchase a truck.

The Cannonsville Reservoir reunion will be held at the Town of Tompkins Town hall on July 27th 2014.
Sewer District:
On motion by Layton, seconded by Buttel, it was moved to approve change order #9.

On motion by Layton, seconded by LaTourette, it was moved to approve and for the supervisor to sign pay application #15.

On motion by Layton, seconded by Backus, to approve the Abstract of Claims for July 14, 2014 for the sewer district in the amount of $313.19.
Vote: All AYEs – Motion Carried.
The invoice received by Ben Reynolds Construction in the amount of $8,200.00 will not be approved until the work is completed at the Fire hall. Bill will inquire about this issue. After the work is complete the bill will be sent to CWC to be paid.

On motion by Backus, seconded by Layton, it was moved to approve the Abstract of Claims for July 14, 2014 as follows:
