The regular monthly meeting of the Town of Tompkins Town Board
was called to order at 7:00 pm in the Town meeting room, Trout Creek, NY.

Minutes Approval:

On motion by Stuendel, seconded by Buttel, it was moved to approve the minutes of the Board meeting held on August 9, 2011.

Vote: All AYEs – Motion Carried.

 

Monthly Financial Reports:

Town Clerks Report:

On motion by Stuendel, seconded by Buttel, it was moved to receive, approve and place on file the Town Clerk’s monthly report for August.

Vote: All AYEs – Motion carried.

 

Supervisor’s Report:

The Town’s monthly financial report was reviewed with Nancy Roberts, bookkeeper to the Supervisor.

On motion by Stuendel seconded by Buttel it was moved to receive, approve and place on file the Supervisor’s Financial Report.

Vote: All AYEs – Motion carried.

 

Guest Speakers:

Brian Albanese – Questioned the issues with flooding on Bridge St. and State Rt. 206. Ron explained he has received a permit from DEC and the
creek will be getting a temporary fix.

 

Other Reports:

Report – Planning Board

None

 

Report – Assessor

None – The board discussed that now they have the extra room
they would like to see the assessor move all Town of Tompkins files to the Town
of Tompkins office building and to have the assessor hold office hours at least
one day per month. Bill will discuss this with the Assessor.

 

Report – Highway Superintendent

  1. CHIPS work is done still awaiting the money.
  2. Ditch work has been done on numerous roads
  3. Rip Rap has been placed on Dry Brook along with drive way pipes being replaced.
  4. Hauled some grit.
  5. Scrap Metal  – Still have not received money
  6. Need more Grit for this year, board also needs to up the amount of grit money for the 2012 budget
  7. Salt shed, paper shed, and fuel shed have been painted by summer help.
  8. Discussed Hurricane Disaster and the flooding
  9. Pipe at George Kehr that boarders the state land needs repair.
  10. 95 Chevy needs clutch work
  11. Cat loader – Eye on end of cylinder snapped off and Dana has fixed.
  12. Hurricane Irene – Loads of trees down but we had minor road damage.
  13. Hurricane Lee – Minor damage, worst hit was LaTourette Rd.

 

Report – Dog Control Officer

  1. Questioned what board would like to do with residents that did nothing with summons that were sent out, after much discussion board agreed that this may be the Judge’s decision and in the mean time contact Deb from Ag and Markets and see if she has any ideas.
  2. 2 Dogs were picked up and taken to shelter.
  3. The dog crate the DCO currently has is falling apart and is beyond repair, after much discussion a motion was made by Layton, seconded by Buttel to purchase a new dog crate. Vote: All AYEs – Motion Carried.

 

Report- Supervisor

  1. Town Signs – Bill has emailed the drawings that Hanna Wagner drew up too Jamie Mullineaux, still awaiting his response on the cost.
  2. Building fund – Discussion on using it for school house and or the pole barn. It was discussed into looking for a grant for the school house.
  3. Cannonsville Cemetery – Paperwork for putting the cemetery in the Town of Tompkins name is at lawyers and when Bill called Lawyer to see how the process was coming, it was found that the paperwork had been misplaced. In the meantime someone is interested in purchasing burial plot’s, Bill has gone through this with
    this person and agreed to sell a 10×90 plot for $1,000 when the paperwork that is at the Lawyers is complete.
  4. Received the money from the City for plowing.
  5. The Boom Mower  has been paid for.

Guest Speakers:

Brian Albanese – Asked if he could put a campaign sign in the Town Building yard. The Board stated he could not due to the fact that you are not allowed to place a campaign sign within a certain number of feet of a polling place.

Report – Assessor

Report – Highway Superintendent

  1. 2 Inch Top has been put down on Higley Spur, part of Higley Rd, Bobs Brook, Windfall and Gray Road.  They will be sealed up in about 2 – 3 weeks.
  2. Cleaned up the lot behind the Salt Shed ( Old TC Sports Bldg)
  3. Will be putting in rip rap on Dry Brook.
  4. More Ditch and Brush work has been done.
  5. Ron questioned how much the scrap metal brought.
  6. Questioned the Stream Corridor Project, and repairs for Chamberlain Brook, Pine Swamp and Mormon Hollow.
  7. Ron asked for more money for Grit also for Sealing of the roads. Much discussion went on about this. The board agreed to hold a special meeting when Ron gets numbers for the cost of sealing the roads.
  8. Summer help ends this week (8/12/2011).

 
Report – Dog Control Officer

  1. 6 Summons issued
  2. Received a call from a resident on Lower Loomis about a dog on their property, picked dog up and took to the owner.
  3. Received a cruelty call, checked it out and was unfounded.
  4. Have 15 dog owners not home when went out to give summons. After much discussion the board agreed to have the summons mailed to dog owners return registered receipt.
  5.  Received a Letter from an upset resident that had received a summons. Board reviewed

 
Report- Supervisor

  1. Vicky Hornbeck will be stripping and waxing floors.  A motion was made by Stuendel to pay Vicky $12 per hour to do floors, Seconded by Backus.              Vote: All AYEs – Motion Carried.
  2. Chris McLaughlin asked if she could place a Barn Quilt (American Flag) on the outside of the Town building, After much discussion a motion was made by Buttel to allow Chris to do so, seconded by LaTourette.                                                                                                 Vote: All AYEs – Motion Carried
  3. Resolution 15 – 2011 – On Motion by LaTourette, seconded by Buttel it was approved to approve Resolution 15 – 2011, The Establishment of the Trout Creek Sewer District in the Town of Tompkins.                                                                                                               Vote: All AYE’s – Motion Carried

 

Correspondence

Ron had received and provided the blue prints from Hannah Wagner for the Town of Tompkins signs – Board reviewed, No action taken.
 

Other

On August 1st at 6:00 pm the board met to discuss FEMA Hazard Mitigation Plan.

Report – Highway Superintendent

  1. Pine Swamp and Grey Road have had new pipes put down. The DEC advised to place a 5 ft squash pipe which was used and seems to be working good.
  2. Dufton Hollow had a pipe put in.
  3. Crews have been doing ditch work, cutting brush, mowing and working on equipment.
  4. Roods Creek had a small wash out and has been fixed.
  5. Franskevicz Road had water running down it and was causing a wet spot, water was detoured.
  6. Sold York Rake online for $650.
  7. FEMA paperwork being worked on from flood damages.
  8. Boom Mower – Tractor is in Mower should be here middle of this month and they will start assembling.

 

Report – Dog Control Officer

  1. Received a couple of dog calls.
  2. Received a strange call from a resident asking to come pick up neighbor’s dog because they no longer want dog, advised the Resident of Dog Control officer’s duties and stated they would have to bring dog to pound themselves.
  3. 19 Summons for unlicensed dogs have been handed out. .

 

Report- Supervisor

  1. Sewer District information meeting for Town residents that will be included in district will be held July 21, 2011 at 6pm.
  2. Received a letter from Kelsey advising they have Bicentennial books for sale at the cost of $13
  3. Village of Walton Swimming lessons – Town will pay for Town of Tompkins children to attend 1 session of swimming lessons. Town will reimburse families after they provide proof of payment and the Village of Walton submits to Layton an attendance sheet confirming the child has attended at least 50% of the session.
  4. New addition’s floor has been laid. Doors will need to be hung and mop board put up.
  5. FEMA Hazard plan will be July 25,
  6. Contract negotiation meeting dates will be August 1st and 9th   at 7pm.

Shelly appeared in front of the board to inquire on their decision on resolution 14-2011.  After further discussion a motion was made by Buttel seconded by Layton to approve resolution 14–2011

Stacey Sovocool – Town Resident

Stacey stated that the Village of Walton is now charging non-Walton residents for swimming lessons.  She asked the board if the Town would be willing to pay for Town of Tompkins’ children to attend these classes with the cost of $45 per session per child.  After much discussion a Motion was made by Buttel seconded by LaTourette to check into this issue and to authorize Layton to make final decision on whether the Town would pay for Town of Tompkins’ children to attend swimming lessons for summer of 2011, due the fact that lessons start before next regular Town Board meeting

  1. There was no auction in Otego so the old York rake was put online for an internet auction
  2. White 1 Ton is running good at this point; some of the work has been paid through General Motors but not all.
  3. 2005 went to country club for a check engine and service air bag light being on.
  4. International is at Ben Funk for valve adjustments and other repairs
  5. Started laying down Calcium on roads
  6. Flood damage – Declared disaster for April 26 – May 8th 2011, working on damage figures
  7. Hauled gravel – Board should consider putting in budget, crushing more stone in 2012
  8. Doing ditch work, fixing signs, mowing, chipping and cold patching.
  9. Work being done on Higley Rd, Higley Spur and Bobs Brook Rd.
  10. Have received the permits for the pipe work needing to be done on Pine Swamp and Gray Rd.
  11. Questioned on hiring summer help. After much discussion a Motion was made by Buttel seconded by LaTourette to allow Ron to hire 2 employees for the summer of 2011 season.

  3. Addition will not be completed by BOCES by the end of school year. Floors need to be done, after much discussion a motion was made by LaTourette, 2nd by Buttel to have Layton go ahead and get estimates and have flooring completed.

  1. Linda Scott 60 days is up and she is doing a great job and states she is willing to stay, Motion to raise Linda’s pay to $12/hr by Layton seconded by LaTourette

Attorney Kevin Young read resolution to establish a Sewer District in the hamlet of Trout Creek.  He indicated the Pete Reynolds property was defined as community Septic System.   It was explained the Town would be responsible to pump tanks.  Tanks would be provided by CWC.  The Sewer District would be 100% funded by the CWC.  A Vote to adopt the Sewer District and resolution being adopted allows for septic tanks to be installed at the homeowner’s property.  Nothing is done without the homeowner’s permission.  Lamont will contact all homeowners regarding tank installation.

Chris Kinney voiced concern regarding the flooding that occurs in the proposed site A.  Chris was wondering if the repair of the creek is included in the plan.  Nate Hendricks, CWC indicated Lamont Engineering has the same concerns.  Problem with the creek started with the flood of 1996.  DEP storm water Wastewater Design Group has a meeting scheduled.  DEP will be reviewing their concerns with the flooding.  Nate assured everyone that nothing would go forward without the flooding problem being reviewed and analyzed prior to final plan being established.

Carl Stuendel made a motion, seconded by Howard Buttel, to pass a resolution to establish a Sewer District in the hamlet of Trout Creek.  [Resolution 2011-13]

In general, the adoption of local law 2011-1 Sewer Use Law as applicable to the Sewer District of the Hamlet of Trout Creek specifies the costs, design, and environmental requirements.

 

The floor was opened for discussion.  No comments made by the public.

 

Motion made by Carl Stuendel, seconded by Peggy Backus, to adopt local law 2011-1 Sewer Use Law for the Town of Tompkins.

Agenda – Public Hearing Meeting

Proposed resolution to Disallow NYC/DEP’s Acquisition of land in fee and acquisition of conservation easements within the 1997 MOA Designated Hamlet Area of Trout Creek

Gail Crane read the meeting notice as was published in the Walton Reporter.

 

Kevin Young, Attorney explained the 1997 MOA and explained that NYC has been authorized to purchase 105,000 acres of additional lands.  The 1997 MOA defines the boundaries affecting the Hamlet of Trout Creek.  It was explained that this meeting is about whether or not NYC can purchase land within the Hamlet.

 

Andrew Tomao questioned what the Hamlet of Trout Creek included.  Shelly Johnson, Delaware County Planning, displayed a map of the Hamlet.

Discussion ensured with Donald Dumond, Jr. regarding his land which is partially located within the Hamlet and he was wondering if the hamlet was being extended.   Kevin Young indicated the sale of land in the Hamlet was determined by tax map number and if the tax map number was in the Hamlet then Mr. Dumond’s property is ruled by the map.

 

The comment period ends on May 27, 2011 on this Proposed Resolution.  The resolution may be adopted by the Town Board at the June Board Meeting.  Shelly Johnson, Delaware County Planning requires 3 certified copies of the resolution restricting NYC/DEP land acquisition in Hamlet once the resolution is passed.

 

Motion by Peggy Backus, seconded by Howard Buttel, to close meeting.  Meeting closed at 7:40 PM.

On motion by Stuendel, seconded by Buttel, it was moved to receive, approve and place on file the Town Clerk’s April’s monthly report.

Supervisor’s Report:
The Town’s financial Statements and Monthly Financial Audit were reviewed with the Board by Nancy Roberts, Bookkeeper to the Supervisor.
On motion by LaTourette seconded by Buttel it was moved to receive, approve and place on file the Supervisor’s Financial Report.
Vote: All AYEs – Motion carried.

Planning Board Minutes are submitted for posting only after they’ve been approved at the planning board’s next scheduled meeting. cfs

The April Planning Board meeting was called to order at 7:00 pm by Paul Bartholomew, member.

Those Present:  Members:  Russell Thurston, Paul Bartholomew, Sebastian D’Agati, Angela Porpora, and Kristin Janke-Schneider for Delaware County.

James Fox was absent.

The following business came before the Board:

  1. Ward Mack, Land Surveyor appeared once again, on behalf of the LoGozzo family, Finch Hollow Road I/S Frank Beers Road.
  • At the last meeting Mr. Mack brought in a sketch plan for our approval.  This month, Mr. Mack has made some changes to the sketch plan.  Mr. Mack also met with the Town of Tompkins Highway Superintendant to discuss access to the property.
  • There have been no soils tests as yet.
  • Mr. Mack has agreed:
    • To let the property owner know a bridge will probably be needed for access to one parcel and that DEP/DEC will need to grant permission for same.
    • To advise the property owner a soils test will be needed ASAP in order to proceed.
    • To give notice of a public hearing to the neighboring property owners.
  • Paul Bartholomew asked Mr. Mack to give us a notarized letter from the property owner (Maria Christina) that Mr. Mack is representing her; as she is the registered owner of the property and not LoGozzo as noted in the letter given the PB last month.
  • Sebastian D’Agati motioned the sketch be accepted as submitted, 2nd by Russell Thurston.  Angela Porpora voted No.  Motion passed 3/1
  1. Kristen handed out copies of Sub-Division Regulations as corrected to date.  She also revisited a previous subject that the Planning Board has been discussing randomly – to amend the Regulations eliminating and changing the simple sub-division to a minor sub-division. She noted the majority of Delaware County Townships have eliminated the “simple”.

It was noted that the e-mail Kristen had sent to the PB was forwarded to Mr. Mack.  The e-mail contained wording that the PB felt should not have been disseminated for public viewing.  It was agreed, that future e-mail forwards must be secure.

The minutes from the March PB meeting were reviewed and an amendment was made.

With no further official business to come before the Planning Board, adjournment of the April 2011 meeting was motioned by Russell Thurston.  The meeting adjourned at 8:05 pm.
