Town Board Meeting – April 8, 2013

The regular monthly meeting of the Town of Tompkins Town Board was called to order at 7:00 pm in the Town meeting room, Trout Creek, NY.

 

Present:

Opening of bids Lawn Mowing:
Bids received:
Adam Stanton – $90 per mow

On motion by Buttel to accept bid received from Dan Gehl in the amount of $74.00 per mow, Seconded by Layton,

Guest Speakers:
Carrie Higley – Was here on behalf of the old School House on Bridge St. She stated there was interest in a Community reunion of all old pupils that had attended the school and they had set up a tentative date of August 11, 2013 and was looking for the Board’s approval. She also stated there was interest in updating the school and doing repairs and that she had been in touch with Cliff Crouch’s office with questions of any grants that may be available to help. Carrie stated that Crouch’s office would need further information on the school and when Carrie had that she would get back to them.
On Motion by Layton, seconded by LaTourette, to approve the reunion and to appoint Carrie Higley Chairmen to upfront the restoration and grant process for the School house.
Vote: All AYES – Motion Carried.
 

Joe Reynolds – was present to answer any questions the board might have regarding a proposed Law 2 of 2013 adopting NYS Uniform Fire Prevention and Building Code as the Town of Tompkins Building Code.  There were no questions.  The Town Clerk will be posting the notice for Public Hearing regarding this matter to be held May 13, 2013 at 6:45pm.

On motion by Stuendel, seconded by Layton, it was moved to approve the minutes of the March 11, 2013 Board Meeting.

Monthly Financial Reports:
Town Clerk / Tax Collector Report:
On motion by Buttel, seconded by LaTourette, it was moved to receive, approve and place on file the Town Clerk/Tax Collector monthly report for March 2013.
Vote: All AYEs – Motion carried.
 

Supervisor’s Report:
On motion by LaTourette, seconded by Buttel, it was moved to receive, approve and place on file the Supervisor’s monthly financial Audit for April 8, 2013 Financial report.
Vote: All AYEs – Motion carried.

 

Other Reports:
Planning Board – None
 

Assessor –
Wendy presented the board with her monthly Assessor report. Wendy discussed that NY State would be taking-over the administration of STAR (School Tax Relief) program from the Towns and their Sole Assessors; and that property owners would have to file online with the NYS Tax Department for future school tax exemptions.

 

Highway Superintendent –

  1. A little plowing and sanding has been done in the month of March
  2. Sweeping of the roads has been done
  3. Serviced and repaired some equipment
  4. Painted plows and they have been stored in the creamery
  5. Brush has been cut on some roads
  6. Opened seasonal roads early
  7. Questioned when summer help can start
  8. CHIPS money has increased this year
  9. Presented quotes for painting boxes on trucks with an approximate cost of $4500 per truck. Quotes were from Truck Body Specialist and Tepco.
  10. Presented quotes to replace 1 – 1Ton Truck
    On motion by LaTourette, Seconded by Stuendel, to approve putting a 2013 1 Ton chassis and cab out to bid.
    Vote: All Ayes – Motion Carried

 

Dog Control Officer –

  1. Nothing solved with using Delhi humane society. Hoping to hear back within the week.
  2. We will need to renew the contract with Crescent Pet Lodge if nothing is heard with Dehli.
  3. One dog was picked up around the reservoir by the Walton DCO due to our DCO being unavailable. DCO Sprague picked up dog from Walton and it was taken to Crescent.
  4. Discussed the “redemption fee” owed by the dog-owner to the Town of Tompkins for dogs that have been picked up and taken to the pound.

 

Supervisor –

  1. Stuendel moved the acceptance, Seconded by Backus, of Resolution #8‑2013,  the Deployed Military Extension, which grants a 90-day interest/penalty free period to make payment upon outstanding property tax bills incurred during an absence caused by combat or hazardous duty deployment.
    Vote: All AYES – Motion Carried
  2. Backus moved the acceptance, Seconded by Layton, of Resolution #9‑2013, the Disposal of Wood Generated as Result of Town Road Activity.
    Vote: All AYES – Motion Carried
  3. LaTourette moved the acceptance, Seconded Buttel, of Resolution #10‑2013,  Town Tax Collector appointment and abolishment (appointment of Town Clerk Michelle Phoenix as Tax Collector; and abolishment of the elected office of Tax Collector).
    Vote: All AYES – Motion Carried.
  4. A discussion on Sexual Harassment, Harassment, and Computer & Internet policies was tabled until next month’s meeting.
  5. The photos from bygone days in the Town of Tompkins that had been sent out to be scanned, blown-up and framed are almost done and will be picked up soon.
  6. Bill discussed the process of approval of monthly minutes. It was decided that the minutes will no longer be read at the end of the meeting for approval. They will be sent out by Email to members for review; and then approved at the following month’s meeting.

 

Correspondence: –
Received letter from our NY State Senator John J. Bonacic stating he was in agreement with our Resolution Supporting of the Second Amendment.

 

Other:
CWMP – A short discussion on what happened at the kick off meeting. A Change order was presented for approval. On Motion by Backus, Second by Stuendel, to approve the changes and be signed by Layton

On motion by Buttel, seconded by LaTourette, it was moved to approve the Abstract of Claims for April 8, 2013 as follows:

Town Board Meeting – March 11, 2013

Guest Speakers:
Steve Brown – approached the board seeking interest in the Town of Tompkins taking over the Fire Tower in Rock Rift. Steve stated that the tower was owned by NYS and NYS was willing to turn ownership over to the town at no charge. After much discussion on restoration and liability issues it was decided that a decision would be made during the Supervisors report of this meeting.

Town Clerk / Tax Collector Report:
On motion by LaTourette, seconded by Stuendel, it was moved to receive, approve and place on file the Town Clerk/Tax Collector monthly report for February 2013.

The Town Clerk also provided all the board members with a copy of the 2012 State Financial Report that was submitted to the NYS state Comptroller.
 

Supervisor’s Report:
The February 2013, Supervisor’s monthly financial Audit was presented to the board by Nancy Roberts, Bookkeeper to the Supervisor.
On motion by Stuendel, seconded by Buttel, it was moved to receive, approve and place on file the Supervisor’s monthly financial Audit for  February 2013 Financial report.
Vote: All AYEs – Motion carried.

Assessor – Wendy presented the board with her monthly Assessor report and answered any questions the board had.

 
Report – Highway Superintendent

  1. Ron presented the board with a check for $1151.43 for scrap metal.
  2. They have been plowing and sanding
  3. Cutting brush on Walton Mountain Rd.
  4. Have had minor breakdowns on trucks.
  5. They have been out 57 times this year for City and County plowing.
  6. They have yet to get the prices for painting the Truck boxes and rails but will get them soon.
  7. Ron would like to replace the 1 ton. Ron has got a price from Chevy for a chassis.
  8. Ron stated that the new residents in the old Kesler farm have placed fence posts in the ditch but have not attached the fencing; Ron stated that when it comes time to do ditches those posts and fence will need to be removed. Bill stated he would speak to the owners and ask them to move the posts out of the ditch.
  9. Quotes from Suit Kote for Dust oil and Liquid Calcium for the section of road in front of Mr. Tarantino’s on Chamberlin Brook. Liquid Calc is 1.16/gal costing about $540 to do the section. Dust oil is $1.70/gal costing about $800. If using Liquid Calcium we can purchase amount needed but if we get the Black Dust oil we will have to order a whole truck load. The Black Dust oil is not made around here so they only allow full loads to be purchased.

Joe Tarantino spoke stating the Calcium did not do its job last year and only worked for a couple days. He stated that either option will solve his problem with the dust or he wouldn’t have come looking for an alternative solution. Ron was asked by the board to get prices on the cost of paving the 2/10th of a mile in front of Mr. Tarantino home.

 

Report – Dog Control Officer

  1. DCO has purchased the new dog crate.
  2. 2 Dogs had been picked up and taken to Crescent.
  3. Contacted the Heart of the Catskill and they stated they had a meeting on the 16th and would discuss taking on Town of Tompkins at that time and would get back to DCO after.  Deb from Ag. & Mkts stated if we had to, we could continue to use Crescent Pet Lodge.
  4. DCO are going to purchase new leashes and cleaning supplies.

 

Report- Supervisor

  1. Lawn Mowing bids need to go out. Town Clerk will put the same bids as last year in the paper to run for 2 weeks and state the bids need to be in the Town Clerk’s office no later than April 8th, 2013
  2. EWP projects – On motion by Backus, seconded by Buttel, it was moved granting the Town Clerk permission to put the EWP projects out to bid.
    Vote: All AYEs, Motion Carried
  3. Town of Tompkins Building Permit Codes. Joe Approached Bill stating there were changes needed in the Town of Tompkins Building Code’s book, Established in 1975.  After much discussion it was found the town needs to set a law stating they are using Administration and Enforcement of the NYS uniform fire prevention and building code. The Town clerk will look into this and get it started.
  4. After much discussion on the Building Inspector/Code Enforcer policies it was decided that he will turn in any money he receives to the Town Clerk the day he receives it.
  5. Bill stated he is going to go ahead and get the pictures done that were discussed last year.
  6. Last month the swing set was run into and the person that had done it stated they will get it fixed. After much discussion Buttel stated he will contact this person and give them a time limit to get this done. After that the board will look into legal action.
  7. In Support of the Second Amendment of the US Constitution – Resolution 06-2013
    On Motion by Buttel, Seconded by LaTourette, it was Resolved that the Town of Tompkins opposes the enactment of any legislation that would infringe upon the Right of the People to Keep and Bear Arms and consider such laws to be unnecessary beyond lawful legislative authority granted to our state representative’s as there is no documented correlation between gun control measures and crime reduction.

  8. NYC has proposed a settlement with the land assessments. A letter and resolution came from Bob Beebe stating NYC is going to maintain the assessments for 2013, 2014, 2015. After much discussion it was decided not to go with the resolution provided by Beebe until more questions could be answered.
  9. Fire Tower Resolution 07-2013. On Motion by LaTourette, Seconded by Backus, it was moved to take over ownership of the Fire Tower at Rock Rift from New York State.
    Vote: All AYEs
    Motion Carried.

Report – Highway Superintendent

  1. Ron presented the board with a purchase order for the pipe that needs to be replaced on Mormon Hollow for $6,701.55

    2. On Motion by LaTourette, Seconded by Backus to approve the purchase order presented by Ron for the purchase of a 40 ft pipe in the amount of $6701.55

  2. EWP Projects – Rock Rift and Readburn No. 2 are 100% done. Pine Swamp and Readburn No. 1 are still in design.  The Chamberlain Brook project is still waiting to hear from City for approval.
  3. Guys have been cutting brush on Walton Mountain.
  4. Have had minor repairs on equipment.
  5. Gravel Bank permit has been renewed and is good from Jan 29, 2013 – Jan 2018
  6. Will be getting $130,118 in CHIPS money.
  7. Stone and pipe bids will be going out in the papers and will set the opening of bids at the March’s Monthly meeting.

 

Report – Dog Control Officer
NYS Ag & Markets have done a Municipal Inspection report for Crescent Pet Lodge on January 17, 2013, and the reports shows the dog shelter to be “unsatisfactory” but also does state that it will be re inspected in apx 30 days and it is anticipated that all deficiencies will be corrected by that time.
Russ is due to have Inspection on Friday February 16th and at that time they will discuss with Deb Toth what steps need to be taken if the next inspection of Crescent Pet Lodge fails.

 

Report- Supervisor

  1. Received a resignation letter from Wendy Layton for her position on the Board of Assessment of Review due to her undertaking the new Assessor position.

    2. On motion by LaTourette, Seconded by Stuendel to accept Wendy Layton’s resignation for the Board of Assessment Review.
    Vote: All AYES – Motion Carried.
    It was discussed that upon investigation there was no need to replace Wendy’s position due to there still being enough members on the board after Wendy’s resignation.

  2. There will be a letter sent out too Mr. & Mrs. Decker in regards to the damage done to the sign located on Decker’s property. It was stated in the letter that LaFever has been reminded by Lamont of this issue and that it has to be dealt with in a timely manner.

 

 

Correspondence:
On 2/11/2013 a letter was received by Robert Beebe in regards to the City of New York v Town of Tompkins, Stating that the proposals will be presented to the DEP Commissioner during the week of February 11, 2013. Thereafter, any recommended settlement will be submitted to the respective principals, the City of NY and our Town.
At this point Beebe explained in the letter that things are in a “holding pattern”, which, giving these circumstances, He believes is acceptable to CWC.

 

Other:
After review and discussion of the membership renewal for the Del. Co. Chambers of Commerce it was agreed by the Board not renew membership due to the Board feeling as if there was no reason for the Town to have such Membership.

A Friendly Winter Reminder – January 14, 2013

The Town of Tompkins Highway Superintendent has requested that our town copy the posting of our neighbor, the Town of Delhi, and present it as our position as well.  So here it is:

It is the Highway Department’s goal to keep Town Highways in a passable condition during the winter months.  Any type of obstruction located in the Town’s right-of-way may hinder the ability of snow removal.

In an attempt to clear the roads, our drivers try not to damage any obstructions in the right-of-way; however, that is not always possible.  Therefore, any damage which may be done to mailboxes, fences and the like, while the Town Highway Department is trying to maintain the roads during the winter, will not be repaired or replaced by the Town, but will be the owner’s expense.

Vehicles parked on the Town right-of-way are also a hindrance when trying to clear the roads of snow.  Attempts will be made to contact the owners of such vehicles so they can be removed.  However, if the Highway Department is unable to reach the owner, or if the vehicle is not removed, the Town will have the vehicle towed, at the owner’s expense.

It is also a violation to plow snow across or shovel back into a Town Highway when residents clear out their own driveways and/or sidewalks.

On motion by Backus, seconded by LaTourette, it was moved to receive, approve and place on file the Supervisor’s 2012 Annual Financial Report as the monthly report.

Building Inspector – Joe presented the board with a new Building Permit Fee Schedule.

Tax Collector – Michelle provided the board with a tax collection report for the board to review.

 

Report – Highway Superintendent

  1. Questioned if the board had heard anything about the permit for the gravel bank. Bill stated he has heard nothing new but will look into.
  2. Plowing contracts will run out on August 31, 2013, Ron stated that need to be reviewed before signing new Contracts when they come.
  3. The pipe on Mormon Hollow by the Kehr residence needs to be changed. Ron stated that 40ft galvanized squash pipe costs about $6,700 and 30ft galvanized squash pipe costs about $5,200. Ron stated these are not exact prices. The Board suggested that Ron get prices and bring back to next meeting.
  4. Plowed and sanded when we had snow.
  5. Cutting brush
  6. 2006 went to Milton cat to have the ECM board replaced.
  7. They have plowed 24 times this season that is up from 14 times last season.
  8. Ron Discussed how he would like to have the Fire District get their own tanks for fuel. After much discussion between the board and Commissioners Higley and Baker. It was decided at this time things with the FD getting fuel will stay the same but the Commissioners will find all keys that FD members may have in their possession and return them. Also when FD needs fuel in an emergency and Kyle McLaughlin is on the FD Call he will assist in filling the trucks. There will also need to be two signatures on the fuel sheets, one from the FD member getting the fuel and one from the Town employee. The Board also advised the commissioners to look into getting fuel and tanks for year 2014 and add it to their budget.
  9. Ron provided the board a write up in the paper from another Delaware County town about Friendly Winter Reminders. – Carl will put the Town of Tompkins Winter Friendly Reminder on the website.

 

 

Report – Dog Control Officer – None

 

Report- Supervisor

  1. Received a letter from Bob Beebe stating that the City is in the process of approving his template. If for any reason this negotiation fails, the Town of Tompkins will want to make use of the TLAP program admistered by CWC.  The Town asked CWC for a one month extension on the enrollment deadline.  CWC and NYC granted this extension.
  2. The Town Sign was installed and it was discovered that the installer had hit the telephone wire and the sign needed to be removed and phone line fixed. The sign is now back in and if there is going to be a cost for the damaged phone line it will go to the installer of the sign. Nothing has been heard about the installation about the other sign for the other end of town.
  3. NYMER Inspector has been here and most went well though there are some minor issues to be addressed. NYMER will send a report on issues to address.
  4. Received a letter from the Delaware County Election board about the possibility of closing Kelsey’s Polling place. Carl stated he will address this with Paul Bartholomew.
  5. Bill discussed with Ron on if Ron had taken any consideration on doing something with the dust issue on Chamberlin Brook. After much discussion nothing was resolved.
  6. Bill called the Association of Towns about the FEMA event Administration fees. After much discussion between board members, they now have a better understanding how to use a portion of the awarded Administration fees to compensate town employees who do the administrative work for a FEMA event.  The board realizes they may have done things incorrectly (or at least could have done a better job of making things transparent) with regard to the payment of town employees who did the administrative work for several prior FEMA events. In the future if there is a FEMA event the board will discuss a rate of pay for administration fees for Ron and Nancy who have been appointed as the town’s FEMA Administrators for the year 2013.

Amended Sub Division Regulations
On motion by Stuendel, seconded by LaTourette it was resolved that the Board of the Town of Tompkins hereby determines that the proposed Local Law No. 1 of 2013 is hereby adopted as local law entitled “Amended Town of Tompkins Land Subdivision Regulations”, and be it further Resolved that the Town Clerk is hereby directed to take such actions as are necessary to implement this resolution and effect adoption of the Local Law.

On motion by Layton seconded by Buttel it was moved that the Salaries of the Town officers for the year 2013 are fixed in the budget and that the Supervisor is authorized to pay the approved salaries.

Highway Expenditures:
On motion by Buttel seconded by Stuendel it was moved that Highway Superintendent to be authorized gasoline, oil, fuel, tires, salt, calcium, batteries and such items to be obtained through state bid contract, also dust oil for use on Town roads with a limit of up to $1,000. Any purchase greater than $1,000 must be done through the Town’s purchase order system.
