The regular monthly meeting of the Town of Tompkins Town Board was called to order at 7:00 pm in the Town meeting room, Trout Creek, NY. With P. Backus leading in the Flag salute.

Floor Time/Guests: Kathy, Mike, Lynne and Tammy attended the board meeting to express their interest and to answer question on installing a Walking Trial in Trout Creek. Wendy Layton spoke with Sean Leddy of Delaware County Planning Department.
Sean relayed the following

“After speaking with Wendy and [after] she delivered the grading plan from Lamont,  she also described that a group of your community members has ideas for developing the property into more than just a trail.  She described the desire to have parking areas, a playground area, possibly river access, the walking trail with a stream crossing, etc.
“I spoke with Shelly [Johnson-Bennett] and we are proposing the following (which is similar to how we have worked in other communities).
“The Town of Tompkins contract with the Planning Department to develop a Park Master Plan with input from a committee and the public.  This plan would represent a conceptual design of the full program of park features and amenities.  The cost of this contract would be $2,500 and could be budgeted in your next fiscal year.  By executing the agreement, I can begin coordinating with your board and/or community group and begin the design process.  The individual elements could be installed in phases as funds become available.
“After the planning stage is complete, the Planning Department will work with the Town (through the existing TPAS contract) to pursue grant funding for implementation of the project. Assuming that NYS allocates funds for park this would occur during the 2024 Consolidated Funding Application (July 2024).
“Planning Department will commit staff hours to assist with grant administration and project management as in-kind match (if necessary).”

The board discussed looking into using COVID funds the Town received to pay for the proposal sent by Delaware County Planning.
The Trout Creek committee will see what interest there may be with residents and future costs and bring it back to the board.
On motion by LaTourette, seconded by Layton to pay $2500.00 to Delaware County Planning Department to develop a Park Master Plan.

RESOLUTION # 73 TOWN CLERKS MONTHLY REPORT

On motion by Albanese, seconded by LaTourette it was moved to receive, and place on file the Town Clerks, monthly report for August 2023.

RESOLUTION # 74 SUPERVISOR MONTHLY FINANCIAL REPORT
On motion by Albanese, seconded by LaTourette, it was moved to approve and place on file the supervisor’s monthly financial reports as of August 31, 2023 dated 9/12/2023. Noted that the monies borrowed from the hwy equipment fund (A1593) was paid back form the Hwy Checking Fund.

After review of the Town Monthly financial report on Motion by Layton, seconded by Albanese, highway monies will be taken out of NBT Bank and Transferred to Wayne Bank.

RESOLUTION # 75 SEWER DISTRICT ABSTRACT OF CLAIMS
On motion by Albanese, seconded by Buttel to approve the sewer districts Abstract of Claims for September 12, 2023 as follows:
$5,370.60.

RESOLUTION #76 SEWER DISTRICT FINANCIAL
On motion by Albanese seconded by Buttel it was moved to approve and place on file the sewer districts monthly financial reports for August 31, 2023 dated 9/12/2023.

RESOLUTION #77 RENEWAL OF HEART OF CATSKILL CONTRACT 
On motion by Albanese seconded by LaTourette to renew the heart of Catskills contract.

NEW BUSINESS
Michelle was contacted by a resident with their interest in putting in a family burial plot on their property. Upon investigation the regulations and rules the Town has never given any kind of permission. Upon further investigation with NYS and other sources it was found that burial is allowed as long as all laws pertaining to burial in NYS.
At this time the board does not have any issues with burial on Town of Tompkins land as long as all laws are followed. And the Town to directs the family cemetery plots approval to the County level for approval. Also that the Town of Tompkins will not be responsible for any maintenance or up keep of these cemeteries if abandoned in the future.

Tentative Budget – Nancy handed board members a budget worksheet with figures for the board to review for next meeting.

Highway Superintendent

  1. Ron asked if the Town has received an invoice for all the road signs that have been purchased. No invoice has been sent at this time.
  2. Ron reported the extended warranty for the 2018 loader. One year it will cost $4262 and two years it will cost $5300. Upon discussion of what it will cover it was decided not to purchase the extended warranty.
  3. Ron reported roads have been put down and some are awaiting shoulders and sealing needs to be done yet.
  4. Ron reported he has received more grindings.
  5. Ron reported they have received help from other Towns and they have helped other Towns
  6. Ron reported roads have been worked and mowing has been done.
  7. Ron reported the 2010 Drive shaft has broken and is now at Cook Bros being rebuilt.
  8. Ron reported he received a call from DEP about no trespassing signs on and around City property on Wagon Wheel Road. The Town spoke of this in the past and it is now time to get the police involved.

Supervisor –

  • Layton called executive session at 8:34 PM. Executive session closed at 8:46
  • Layton stated the 18th of September members of the Town and NYC will review where the fire tower road will be installed.
  • The coffee maker was donated to the Town
  • Layton spoke with a contractor that has insurance. He will advise him of all that needs to be done and find what the cost will be.
  • Bill reported of an email that Michelle has received in reference to Wagon Wheel Road. He observed posters everywhere that did not want to trespass. Bill Stated he will contact him back stating this is nothing the Town or City has done and that road is a public road and any issues with being on City Property that is open should be take up with the City Police.
  • Layton reported that Nancy should become the budget officer with income starting in 2023.
    On motion by Albanese, seconded by Layton to appoint Nancy Roberts as the Budget officer as of September 12, 2023 at a fee of $2500.00 a year.

Floor Time/Guests: Ashley Lakin asked the board what the guidelines are for the Town to pay for her children to attend swimming lessons. This year she could not attend Walton free lessons because they were full so she drove to Andes which were also free. The board will look into guidelines for the Town to pay for swimming lessons.

RESOLUTION # 67 TOWN CLERK’S MONTHLY REPORT
On motion by Backus, seconded by Buttel, it was moved to receive and place on file the Town Clerk’s monthly report for July 2023. Also noted that there was a discrepancy between the Clerk’s report and July’s Building Inspector’s report. After the Building Inspector corrects the discrepancy a new building inspector report for July will be printed for the board to review.

Planning Board – Layton spoke with David Bagley on filling the open position for a planning board member. David Bagley agreed to take the position and schooling for a planning board member.

Highway Superintendent

  1. Ron reported he received a letter for the 2018 loader to extend its extended warranty. Ron is waiting to hear back on the cost and what will be covered.
  2. Ron reported the insurance company is concerned about vehicle fires for the trucks that do not have a battery disconnect. Layton will call them to ask further questions.
  3. Ron reported he received the email from Nancy requesting figures for the 2024 budget, he stated he is working on it.
  4. Ron reported that gravel hauling from Afton has started.
  5. Ron reported, Pipe has been changed, roads have been graveled, Walton Mtn Rd has been paved, helped other Towns, and mowing has been done.
  6.  Ron Reported the Massey had repairs done on the front end.
  7. Ron reported the dozer needed new parts; it also has no power.
  8. Ron Reported the brush hog has been fixed. Its time to replace it
  9. The 2007 is out again for repairs.

Supervisor –

  • The Town board received a thank you card from Emma, Lilly and Ella Beers for sending them to the 2023 4-H Camp.
  • Spoke with Dave from NYC about the marked areas for the roadway that will go to the fire tower for repairs. He stated everything looks good but to get back to him and to confirm with the utility companies that everything is okay and to contact UDig NY before work begins.
  • The wage sheet for the Town employees needs to be updated.
  • A title of Budget Officer needs to be given to Nancy and discussion of wages for that will be brought up at next meeting.

OLD BUSINESS –
Layton, Albanese and Buttel walked and marked the area where the fire tower road will go for maintenance of the fire Tower. Layton contacted the electric company to be sure there was no underground lines and nothing will be disturbed. It was founded where road will go will not disturb any power lines.
On motion by Albanese, seconded by Buttel to have the roadway to fire tower placed on NYC land and not to use Dester’s right of way.
Vote: All in favor, Motion Carried.

The storm-water retrofit bed on State Highway 206 by the Sewer District building has been weeded and looks good. Albanese offered to bush hog down the bed by the office building due to the high amount of wild parsnip that has grown in the area. The bed will be assessed at later date for replant.

A new court clerk has applied for the position, Linda will be training her. On motion by Layton, 2nd by LaTourette the new employee will be paid the same as the current court clerk.

It was noted that Dawn from Mostret Mansanero and Scott did not attend the meeting to review the status as requested.

RESOLUTION # 63-2023 AGREEMENT FOR CONTROL OF SNOW ON NYC ROAD FROM SEPTEMBER 1, 2023 ENDING AUGUST 31, 2025.
On motion Layton seconded by Buttel the Town of Tompkins agreed to the agreement provided for Control of snow on NYC road from September 1, 2023 ending august 31, 2025.

RESOLUTION # 64-2023 AGREEMENT FOR CONTROL OF SNOW ON COUNTY ROADS BY TOWN FORCES PURSUANT TO SECTION 135-A OF HIGHWAY LAWS.
On motion Layton seconded by Buttel the Town of Tompkins agreed to the agreement provided for Control of snow on NYC road from September 1, 2023 ending august 31, 2025.

Ron reported:

They would like another tractor to make mowing banks easier,
He is waiting for the crushing in Afton to begin.

Ron advised the board the Town needs to update the Town Law in regard to the condition of new roads for the Town to take them over in a subdivision.

Layton stated he heard back from NYC on the letter received by a Town property owner on Wagon Wheel Road. After Layton sent NYC all the letters received, NYC stated they never wrote the letters and that DEP is not willing to have the road abandoned like was stated in the letter. 

Other – More info will need to be proved to the Town in reference to the Town paying for Swimming lessons in Delhi instead of 4-H Camp.

Albanese asked Ron VanValkenburg if he received any interest of youth summer help for Town Highway. Ron reported that there was none at this time. Layton reported if there was no youth interest for the highway the youths can be hired to do tasks around the Town Hall.

REPORTS:

Sewer District worker’s report – Provided.
Contact will be made with the Lawn care provider on weed eating not being done around the SD Fence and the tank covers. 
Layton stated he contacted Leo’s Lawn Care about the issues with the storm-water retrofit beds. They will get back to him with the price.

Assessor – Nothing to report

Planning Board Still looking for an alternate for the planning board.

Dog control Officer – None
Backus spoke with DCO about the enumeration and was told he will have to come up with a plan for the process.

Highway Superintendent

  1. Ron reported a new radiator was needed for the 2023 International and was covered by warranty 
  2. Ron reported – Brush has been cut, Roads have been worked, Dust control has been put down, Repairs have been done on the boom mower,
  3. Ron reported a pressure washer will be purchased for approximately $3630.
  4. Ron reported Carver crushing will be done hopefully by the end of July.
  5. Ron reported that he was approached by an individual that lives on Franskevicz Rd. Spur requesting that portion of road be abandoned. The Property owner was advised of the process they would have to take.
  6. Ron reported that CHIPS is enforcing the 10 year resurfacing limit. Causing the town to resurface roads every 10 years not the 5 years in past. 
  7. Resolution #56 – Resurfacing Walton Mountain Road
    On motion by LaTourette, seconded by Layton it was moved to allow resurfacing Walton Mountain Road using the funds from 5110.4 due to new CHIPS rules.

Supervisor –

  • Layton reported that approx. 25 ft behind Gardepe, Griffin and the Legion that is on County route 27, is being mowed. The only issue that this may cause is that area may become the walking trail. It was also found the Town has a right of way between Gardepe and Griffin.
  • Layton reported he called Mike Ruling on repairs that have to be done around Town Bldg.
  • Layton reported that Backus also contacted someone about repairs but at this time he cannot commit.
  • Layton contacted the Water Bottle company and asked if they could no longer provide water bottles until they are contacted, due to the accumulation of unused bottles provided.  
  • Layton reported that 2 individuals have inquired about the court clerk position but have decided not to take the position. Another individual has inquired recently and they will contact Linda.
  • Layton reported he went around Town Hall and put all electronics that are no longer used. Albanese will take them to the dump.
  • Layton reported he received letters from a property owner on Wagon Wheel Road asking for abandonment of that road. Layton inquired with NYC and they requested the letters. All were forwarded to them.
  • Layton reported on the progress of the fire tower. A sign will go up stating that there will be no trespassing/ private property. Any board members who are interested in where the road will go are to gather June 22, 2023 at 6pm to see where road will be placed.
  • Layton reported that all the floors at the Town Hall have been stripped and waxed by Floor Fool.

Received a thank you letter from Sierra Allen thanking the Town for paying for her 2023 4H fees.

Floor Time/Guests: Tammy Wagner represented the Community Committee. Tammy asked the board what their thoughts were on the Walking Trail and where they thought it would go. She advised the board that they should view the one that was put in Deposit and all the different attributes it has and to take into consideration some of those aspects. Albanese stated that they should begin with a survey to see what interest there would be with putting in a walking trail. Kathy Preston advised the board they committee will be putting in annual flower gardens at the school house location. The board agreed that would look great.

On motion by Backus, seconded by Albanese that in August of 2022 the Board voted to use $53,295.81 of ARPA funds to pay for the new engine that had been purchased in March of 2022 for the Highway Department. In attempting to file the required annual report of ARPA money spent between March 2022 and March 2023 it was not clear if the use of the ARPA funds qualifies under the rules the Federal Govt has sent out. Consequently, the Town Supervisor, as CFO, has transferred the $53,295.81 from the Hwy Dept back to the ARPA account until clarification of its appropriateness is ascertained.

OLD BUSINESS –
Albanese explained after contact with the individual that was going to give him a quote of Maintenance of various items of the Town bldg. The individual stating, he was too busy and was unable to quote the job at this time. The board will again ask around for quotes.

Albanese asked why the Hwy crew was starting work at 5am with it being dark at that time. He also asked if summer help would be utilized this year and if they too would be starting at 5am. VanValkenburg stated the crew gets thing ready at the shop at that time and summer help would not be starting at 5am they would start at 6am.

Nate Sramek attended the meeting to discuss how the code enforcement position was going and provided an update on the progress of taking over the position. He has requested the board to look into any ordinances or regulations they may or may not want to implement on commercial solar farms, as he has been receiving calls in regards to them.

NEW BUSINESS –
Backus advised the board that she questioned why the Town no longer has a rabies clinic and was told by the County that due to Covid it was never scheduled and the clerk being there doing licenses in the past is why it was never scheduled. It will be checked on for 2024

REPORTS:
Sewer District workers report – Brett was available to respond to any question or concerns on the SD. He will look into what can be done for settlement around Lateral lines caps.
Brett stated staining of the bldg. and stands should be done soon. 

Assessor – Nothing to report

Planning Board – Tim Bennett stated a replacement of Charles Kohler will need to be done.

Dog control Officer – None – Backus is going to speak to DCO again about the progress of the enumeration.

Highway Superintendent –

  1. Ron stated the renewal application and $300.00 need to be done again for bulk storage of petroleum. Layton will have the application and fee sent out.
  2. Ron reported he received a letter on how much the Town will receive in CHIPS. Ron stated he didn’t feel it was correct and has made contact with Broome Co and it will be looked into.
  3. Ron reported the current pressure washer if faulty and a new one is needed. He figures a new one will cost between $4,000 – $5,000.
  4. Ron reported that a lot of items need to be thrown out. Layton will call about dumpsters because the Town bldg. has tons also. 
  5. Ron reported that a resident is putting brush and trees in ditch, this could cause issues in the future.
  6. Ron reported that boom mowing, brush cutting and repairs has been done.
  7. Ron reported that logos have been purchased and placed on trucks.
  8. Ron reported Boom mower has been fixed and is working at this time.
  9. Ron provided a paper stating the Hwy can go off piggy backing law for purchases.
  10. Ron questioned Albanese if he knew the cost of a lift, Albanese stated they are between $30,000 – $35,000, he also stated it may be cheaper to rent one due to the little use.

Supervisor –

  • Layton would like to have the following positions advertised; Planning Board Member, Deputy Clerk, Court Clerk and deputy Bookkeeper.
  • Layton reported upon asking human resources for the County he found the pay $13,000 per employee, In the future the board will have to put additional expense for unemployment ins in the budget
  • Layton and others went to the fire Tower and marked out where the road will go for the repairs. The rest of the board would like to view the area in the future.

Layton will speak with the owner of Floor Fool to see if they can strip and wax the Town Bldg floors.

Received an application for 2023 4H Camp from an out of Township child. The application was denied because the child was not a resident of the Town of Tompkins

  2. Ron asked if anything came about with the highway getting a credit card. It will be looked into.   
  3. Ron reported the boom mower had been fixed then 3 days later after use it broke down again.
  4. Ron reported boom mowing, chipping of brush, sweeping and cutting of trees had been done.
  5. During the fire that had happened on 4/10/2023 a hole was created on Peggy switch and has been repaired.
  6. Ron reported that a quarry worked by Sonny & Son has been started on 67. They will be producing crusher run. Kingswood road will be being repaired this year and Ron asked if he could get the crusher run from there costing about $15 per yard. Due to the location, it will be cheaper in fuel. Board Agreed.
  7. Ron asked what summer help will be paid in 2023.

    On motion by Buttel, seconded by LaTourette the 2023 wages for highway summer help will be $15.00 an hour.

  8. Ron reported there are many road signs missing again. He spoke with the County and they are making new ones that may be harder to steal.
  9. Ron Reported they had received prices for a new John Deere and mower. With the trade in of the one they have the cost will be $72,493.86. Layton will check with County and see if this has to go out to bid or it can go off another bid from others. Ron was asked not to go ahead with purchase until questions are answered.
    After questions are answered, on motion by LaTourette, seconded by Buttel to purchase John Deere and mower through Cazenovia equipment at price provided.

  10. Ron reported that Suit-Kote said the prices of the oil went down.

Supervisor –

  • Layton will check with the county on the amounts the town should carry to unemployment.
  • The easement for access to the fire tower has been done and filed with the County 
  • Layton spoke with Stacy from DEP and Steve Brown about what needs to be done with the fire Tower. Them and others would like to get together to go to the Fire Tower and take a look and to figure out next steps will be.

OLD BUSINESS:
Light Duty – Albanese contacted Tony from the Teamsters Union to discuss the towns position on an employee that is injured outside of work and the requirements to return to work. Tony advised that the town has the right not to allow any employee to return to work until they can perform their normal work duties without restriction. However, if the town was to have a written formal return to work policy, it would need to be reviewed by the union to confirm it does not conflict with the collective bargaining agreement currently in place. 

Mowing of the Town Properties and SD, The Town clerk will check with the individual that performed the Town and Sewer District mowing in 2022 to inquire what Mowing fees would be in 2023, if the amounts are the same as 2022 the board would like them to continue to mow in 2023. 

Albanese met with an insured contractor to review the list of repairs needed on the building, he will provide a quote for the April meeting.

  3. Ron reported he received the statement from Carver for $50,613.13 and would like to get it paid ASAP.
  4. Reported plowing has been done 14 less than 2022 times
  5. Reported Repairs, Brush cutting and boom mowing has been done.
  6. Reported the boom mower has mechanical issues and is awaiting parts to be repaired.
  7. Reported that they will be getting quotes for existing tractor and mower due to safety.

Buttel provided the board with the steps that have been taken for the Fire Tower

Albanese question the amount of funds carried for the A231 NYS Unemployment. Albanese to discuss this issue with Layton when he returns, so he can verify with the County how much is required in the fund to be sufficient with changing Unemployment rules.

  1. Ron Provided to Layton the 2023 Wage Statement to give to Meta Russel
  2. Reported the Highway received a check in the amount of $5200.00 for the sale of the 1995 Pickup truck.
  3. Reported how much the Town pays to plow County and City Roads. The Town does not get reimbursed from the County and City what they pay. It was discussed that the State Comptroller sets the reimbursement costs for each Town. The contract is a 5-year contract and is coming up soon.
  4. Reported the Agreement to spend highway funds has been received and had been filled out. It was signed and will be sent back to County.
  5. Reported plowing, Tree cutting, and equipment cleaned 
  6. Reported that he would like to get a manlift for the guys to get higher in the air to cut trees and tree limbs. Albanese mentioned renting one, Ron will look into that option.
  7. Reported Overhead doors needed repair and has been done.
  8. Reported the Edwards mower has a new hydraulic pump on it
  9. Reported an alarm went off this am and it took 8 minutes to get to 911.
  10. Ron would like Board members to stop in and see how clean the shop is.


Supervisor –
On motion by Albanese seconded by Layton; Supervisor Layton will close all accounts of the Town of Tompkins Supervisor fund at community bank and transfer monies to NBT and Wayne bank. Layton will open CD’s at Wayne Bank & NBT for the good neighbor, unemployment fund and Highway equipment reserve fund. Layton to discuss terms and amounts of the CD’s available in order to set up accounts that best benefit the town and its financial requirements.

Received a donation letter from the Trout Creek Emergency. Board would like for squad to come to a meeting and explain what they are looking for.

Layton asked about “Safety Equipment “for the Highway employees. Nancy made up a form on what each employee is owed for Boots from the prior year. Tim Oralls was here and expressed how he had asked for 2 years of highway Abstracts to see what is owed to him. It was decided that those owed for $250 for the prior year to submit receipts as the contract states.

Layton asked if the Town should do a policy for Highway workers to return from a non-related work injury or illness for full duty. Albanese will email the Teamsters Agent Tony and confirm this does not conflict with the current agreement in place. 

Received the letter on January 27, 2022 for the Local American Legion dated Nov 2022 asking for a donation. The board agreed to pay $400 for 2023 and to advise them to send another request for 2024.

Layton provided and update on the fire tower.

Layton questioned hiring a handy-person as an employee for all the work that needs to be done to the Town of Tompkins Town Hall. Layton will speak to the guy he showed everything in the past if he received insurance. Board will go from there.
