The regular monthly meeting of the Town of Tompkins Town Board was called to order at 6:00 pm in the Town meeting room, Trout Creek, NY. With Brian Albanese leading in the Flag salute.

Guest Speaker: Don Dumond discussed with the board “ Zombie Properties” and what the Town could do to have the Banks / Owners of properties that are unkept be maintained. The board Stated they will look into this issue.

Highway Superintendent –
1. Taking care of roads
2. Had some repairs
3. Ron questioned if it was still okay to help out the farmers, by putting down grit in their barn driveways so the milk trucks can get in to pick up the milk during the winter months. The board stated they see no issues with that and it could continue to be done, due to it assisting and helping then stay in business in the Town of Tompkins.
4. We have the massey tore apart due to it breaking down.
5. Ron asked the board if he could order a 2020 international. Albanese stated that at December’s meeting there was a motion that was passed that the truck needed to be put out to bid.

Dog Control Officer – Still looking for a DCO.

Supervisor –
1. There is a grant being looked into to get the fire tower fixed.

2. Nancy stated that Carl will update and maintain the website in 2019 if the Board wanted. The site is going to be an additional $10 a year.
On motion by Albanese, seconded by Buttel if was approved to have Carl Stundel keep the website open and to approve the increase fee of $10 a year to remove adds on the site.

Sewer District:
On motion by Backus, seconded by Buttel to approve the Abstract of Claims dated January 14, 2019 for the sewer district in the amount of $4334.56

The water filter has been installed at the schoolhouse.
Albanese stated that we should ask the reporter to come see the improvements on the schoolhouse and all that the committee has done.
Layton spoke with Tim Bennett again to see if there was any news on how the community felt about taking over the Kelsey house. Tim stated he hasn’t heard anything yet.
Albanese stated he received a post card in the mail from DTC and if you want you can go to their site and sign up to get hooked up when they start doing hookups.

Highway Superintendent:
1. Maintaining roads during storms
2. In 2019 we have used 2,200 yards of gravel on the roads
3. Been out doing some boom mowing and chipping
4. Equipment is being fixed so it is ready for spring.
5. Ron stated he would like the part in the subdivisions on “building roads” in Tompkins to have the specifications changed to “Road to have a double shot of hot cold pug mill mix to placed on the road”
6. Ron looked into the price to have framework and wiring harness put on new truck so that we could use the plow we already have and it would be about $ 2,200.00 and to purchase a new one and have it installed it would only be $ 5,700. After a short discussion it was agreed by the board that they want to use the plow on hand and not purchase a new plow. Ron stated that if that’s their decision that the truck that will be replaced will be sold without out the plow so that he has an extra on hand if ever needed.

Supervisor:
1. Bill was contacted by Delaware Co DPW and was told that the measurement for the bridge on Bridge street (By the school house) was incorrectly measured and that it is under 20ft so it will be handed back of to the Town to maintain.
2. DTC will be here at the Town office building to hook up service on December 18th
3. Bill has contacted the Lawyer questioning the status of the sale of the property on 206 located on the “White Barn” property. Bill had to go sign final papers for the sale and then the papers will be sent to the purchases lawyer for their signatures. It appears it will be all finalized in the near future.

 

Other –
Ron questioned if the Town was going to buy the highway department a TV seeing how DTC Hooked up cable service. After much discussion it was decided that the Town will not purchase a tv for the Highway garage.
Albanese also questioned why the Town office building needs to have cable for a television.
Albanese stated there is still so much confusion with the grant for the creamery building with the state. He had forwarded the email to Bill, Nancy and Michelle he received from them to help clarify their questions. Michelle will send Brian the block grant agreement with CWC that may help the grand administrators understand.

Highway Superintendent –
1. Ron send the P/O for the new truck to Robert Green. Albanese questioned if we are getting the extended warranty. We did not put in the bid specs for the extended warranty. Albanese suggested we look into adding that on.

2. Black top done on Tower Mountain

3. No more hauling of grit for 2019 per the boards explanation as to the budgeted amount for grit for 2019 has been met.

4. Cut tree limbs, trucks prepped for winter,

5. Scotts truck is at stadium for repairs

6. 2013 1Ton is at Scoville Meno for repairs to wheel barring’s and brake caliper.

7. Ron questioned how the 3-hour time off thing works for employees being able to vote during election.

Supervisor –
1. On Motion by Albanese, seconded by Backus to authorize Layton to execute the land sale to Ralph Shakarian in the amount of $ 1,667.00 and all closing costs to be paid by Mr. Shakarian.

2. DTC as sent Bill an estimate on prices for the Highway Garage, school house and Town Bldg. Install date will be November 14 for Highway garage and Town Bldg. and November 15 for the School house.

3. 4- H Sent an email stating that the costs for 2020 will be increasing.

4. On motion by Albanese seconded by Backus to accept the 2020 preliminary budget and make it the Final 2020 budget.

Other:
Albanese has received another request for additional paperwork to be completed and send for the creamery grant.

Albanese questioned if the sexual harassment has been completed by all the Town of Tompkins Employees. Ron stated his guys did it.

School House roof is good and payment can be made.

Nancy has received the asset tags. Anything costing over or a value of $500 will need to receive a tag.

Guest Speakers:
Janet Hulse approached the board asking what they thought about a project she would like to do. The Board seen no issues with what she would like to do for the community.

Toro Ruben – discussed his interest in purchasing the Kelsey Community House if the Town ever was to sell it.

Lynne VanValkenburg questioned the status of putting in a phone/internet at the School house for emergency purposes. Lynne also asked if we could rent to people living outside of Tompkins. It was agreed upon by the Board that it will be allowed but they must pay $75 for rental and a $25 deposit that would be returned providing everything is as they left it, also they much supply a homeowner’s rider. Lynne also stated the upcoming events planned by the community committee.
Lynne, Mike and Kathy expressed their concern with the way the new roof on the school house was done and it being done in a rain storm, causing damage to the interior of the school house.
Brian examined the school house after the rain storm and noted there was a lot of wet insulation and the longer the wet insulation sits, there will be more issues to arise. Brian stated he took pictures and will be discussion this with the contractor.

Bids:
One bid was received for the 1Ton by Robert green, Bid was submitted on time and had all required paperwork. Board received the bid to review prior to the meeting.
On motion by Albanese, seconded by Buttel, it was moved to accept the bid from Robert Green for the 1 ton in the amount of $40,393.00

One bid was received for the 2019/2020 snow plowing season for the sewer district properties from Sam Galley. Bid was submitted on time and had all required paperwork. Board received the bid to review prior to the meeting. On motion by Albanese, seconded by Layton, it was moved to accept the bid from Sam Galley in the amount of $90.00 per occurrence.

Supervisor
1. Reviewed tentative budget, changes will be to 1410.12 from $11.00 to $11.10 to reflect increase in minimum wage, 3510.1, decrease by $57.00 and DA5142.1 Increase to $6,000. On motion by Albanese, seconded by Backus, to make tentative budget the preliminary budget with changes and to set up the public hearing for next month’s meeting. Vote: All Ayes.

2. Bill provided the quotes he had received from Delhi Telephone Co. for the Town of Tompkins, will get the Internet and TV as a free service for all Town owned properties, but will have to pay for phone service. Brian stated he had received different quote amounts. On motion by Albanese, seconded by Buttel to accept and change all Town owned properties, excluding the Sewer district’s service, upon finding out if the Town is in any contract with Frontier and clarification of the discrepancies between the two quotes, Vote: All Ayes

3. Bill showed a letter he had wrote up to the land owner by the Fire Tower asking for a right of way for the Town.

4. Bill found out that we can proceed with the sale of the lot located on the Acuri property can be sold to the new owner of the Acuri property, Ralph Shakarian. Mr. Shakarian must pay the assessed value of the property and all legal fees.

5. Discussion took place on implementing and the training of the new sexual harassment policy.

Other – Brian stated all paperwork has been submitted for the creamery grant for reimbursement and as of yet has heard nothing back.

Other Reports:
Sewer district workers report – Report provided, Brett was here to discuss report and upcoming sewer budget. He stated he would like to purchase an air release valve to have as a backup, costing about $800. He stated that we should purchase a Flow meter because it’s becoming an obsolete part and it will eventually need replacing, the cost is between $5,000 and $6,000. Brett stated he has contacted Oneonta fence company to replace the fence door by the grit pile because its not closing properly. Brett has also scheduled the flow meter calibrations.
Snow plowing was discussed for the sewer district and it will be advertised in the paper.

Highway Superintendent
1. Ron has brought back prices from Radio shack in Walton for the refrigerator / cooler prices to replace the one that has gone bad over to the shop. Glass door one is $599 and the regular one is $549. The board agreed to let Ron purchase whatever one he wanted.
2. Roads sealed – Walton Mtn needs to be looked at again because it didn’t seal properly last year so he is seeing if it is covered under some warranty.
3. Pipe changed on Pine Swamp
4. Ditch work done
5. We may be able to get grindings from Deposit to use one Roods Creek and Hathaway Pond Rd.
6. Hauling grit. Ron stated he has $2715 left and questioned if he can use it or does he have to wait until next year.
7. Ron asked if he can hire someone to do boom mowing and they be paid $14.00/hr. Bill will look into it.
8. Ron asked if he could get a bigger door on the creamery so he can get the larger equipment in there.
9. Ron stated they need winter tires.
10. Dana has worked on the dozer. Should work good now.
11. Dana will be fixing one of the truck boxes.

Supervisor
1. Bill has not heard back from Delhi telephone yet. Tim stated they will be at the Trout Creek fire hall on the 21st for a meet and greet.
2. The little parcel of property on the white barn property must be sold for $1667. Bill is going to ask a couple more questions from Del Co planning then we will proceed with the sale.
3. OSC States we have to put asset tags on equipment.
4. Bill / Nancy provided the 2020 budget for review and if any questions bring back to next months meeting.
5. Sexual Harassment training needs to be done by October 9, 2019.

Highway Superintendent
1. Ron questioned if the board seen the specs for the truck he wants to put out to bid. The board agreed to go ahead and put the truck out to bid. Bids will be received up to Oct 2 at 12:00 and opened publicly in the Town clerk’s office at 12:30 Oct 2nd. Bids will be awarded at the next board meeting held on October 8, 2019.

4. Been out hauling gravel, working on equipment, done pot hole work, Helped other towns.
5. Summer help is done
6. Gretchen will be done after this week.
7. Ron stated the break room cooler is not working and questioned if the Town would buy then another one. Ron will get prices and bring them back to the board.

Supervisor
1. There was no petition to deny the selling of the small piece of property by the white barn. We will see what our next step is and proceed. We must ask for the FMV of the property per Municipal law.
2. 4-H camp is done and we received the bill in the amount of $3233.00 and we have sent 15 children from the Town of Tompkins to camp this year.
3. Bill is looking into switching the Town over to Delhi Tel and will come back with prices and information.

Highway Superintendent
1. Working on 2/10 of a mile on Tower Mtn. There is 7 miles to do in the future.
2. Ditch work, Pipes changed, mowing, pot holes filled, and boom Mowing has been done.
3. Working on equipment

5. Dust control has been applied
6. Getting another $31,152.99 for extreme weather recovery from NYS. Ron wants to use it to seal a portion of the road that goes to the Rainbow. And to buy stone.
7. Ron would like to put a truck out to bid but is having trouble getting information he needs to do so.

Supervisor
1. We were turned down for the Fire Tower Grant.
2. Received the ballot for the executive committee of coalition of watershed Towns.
3. School house roof – On motion by Buttel seconded by Albanese to award the bid received from Frank Morgan for the replacement of the school house roof. Vote: – All Ayes, Motion Carried.
4. Sale of the small property in front of the Big White Barn. On Motion by Buttel, seconded by Backus to approve resolution 13-2019, Declaring Town of Tompkins tax map number 227.-1-1-31 surplus property that is subjected to permissive referendum, and to advertise as such in the Reporter. Vote – All Ayes – Motion Carried.

Highway Superintendent
1. Working roads in between rain storms

5. Employee will be out of work for a long length of time and may not be back until beginning of year

7. The temp employee is doing good running broom and mowing.

Supervisor
1. Bill presented the board with information for the new Election law for employees.
2. Working on process to sell Kelsey property and the small lot on 206. Paul Eaton is working on it
3. Provided the board with a sample policy on the bidding process. On motion by Albanese, seconded by Buttel to start using the new guidelines for the bidding process. Vote: All Ayes
4. Discussed the rain gardens and the upkeep of them

Other
Albanese provided the board with speculations for the repair of the school house roof. The board reviewed them. On motion by Layton, seconded by Backus to put the bid out in the paper.

Albanese has contacted a painter exterior of the school house and it is scheduled to be done in the 1st week of July. Forno enterprises are covering all costs

Highway Superintendent
1. Ron provided his request for the “Agreement for Highway Expenditure’s”. On motion by Backus, seconded by Buttel agreeing to the repairs and submitting he agreement Delaware County and also filed in the Town of Tompkins Clerks off of the following: Eastview Rd to St. Rt. 206 – 1.01mile’s, Windfall Rd to St. Rt. 206 – 2.17mile’s, Higley Rd – St. Rt. 206 – 1.30 mile’s, Abe Boice Rd – St. Rt. 206 – 1.05 miles, Bullock Hill Rd – St. Rt. 206 – 3.64 mile’s, Castle View Rd – Bullock Hill Rd – .60 mile, Locker Ln – .40 mile, Mountain view dr. – .72 mile.

2. Been out fixing roads, and repairing small damage from a rain storm.

3. There has been an issue with beaver’s on Readburn Road, they had filled in one of the pipes and caused damage, the pipe has been changed and Ron has looked into what needs to be done to trap the beavers.

4. This year we had received $203,534 in CHIPS

5. Ron stated that the 2007 International dump box needs replacing, Ron has received an estimate and questioned if he can get a new one.

6. Ron would like to replace the 2014 1-ton it is rusting out. This truck would make someone a good truck.

7. The sander for the 2014 1-ton needs replacing and would like the board to consider replacement, Ron will bring back prices to next months meeting.

8. Ron questioned if the Town was approved to get summer help. He was approached by two girls asking for the positions, they are both over 18. Ron questioned the pay they would receive. The board stated summer help will be paid $12 and hr.

9. Ron stated he would be short handed until January 2020 due to an employee going out for surgery. Ron asked if he could hire a part time person to fill the spot. Ron stated he was approached by Gretchen Decker to fill the position for the summer until she goes back to college. A discussion took place as to what the Town would have to do to hire a part time employee.

Supervisor
1. Bill received a call from a realtor questioning what needs to be done for the Town to sell the small section of property on the Acuri property. Bill stated he would bring it up to the board. It was discussed that the Town will sell the property. Bill will contact lawyer as to the process that needs to be done.

2. Chad Trimbell stated he has contracts for all the generator servicing and will get them to the Town for approval.

3. Bill brought up the that the Town should have a purchasing committee(s). It was agreed that Tim LaTourette and Howie Buttel would be on the Highway purchasing committee, other committees for purchases will be figured out at a later time. Purchases shall be as follows, Committee gets together with employee or office requesting a large purchase and they will agree upon the item for purchase, they will gather all information for the item requested purchased and bring their recommendations back to the Town Board at an official meeting. The Board will review the recommendations and agree or not agree to have the committee do the specifications and advertise in the paper. The advertisement will state all bids to be sent or given to the Town Clerk, it will also state that the bids will be opened publicly at the Town Clerks office on a specific date, during a set clerk hour. The bid opening will also be 1-2 weeks before a Town Board meeting. The Town clerk will stamp each bid as it is received with date received. The Clerk will open the bids publicly and record bids received. The Town Clerk will make copies of each bid received and give copies to each board member for review before the next Town Board meeting. At the next available board meeting the Town Board will vote to accept or decline and or award a bid.

On motion by Layton, seconded by Buttel to approve the following campers to attend 4-H camp in 2019. Sierra Allen, Kendyll McDonald and Levi McDonald.

Brian questioned again as to status of the sale of the Kelsey building.

Brian had brought up about the replacing the roof of the Town building, after a short discussion the board felt there was no need in replacing it at this time.
Brian also stated that the School house needs to have roof replaced before all the work and money that was put into it to repairs are ruined.

Sewer district workers report – Provided – Brett was also here to discuss his concerns with the amount of high flows during snow melt and rain storms. It is possible that there is a resident that has connected a sump pump to the sewer lines. Brett and Shane will be out investigating the situation and in the mean time suggested we find a way to notify those on the system of not hooking drain lines to the tanks.

Highway Superintendent
1. Ron has received a letter from Navistar that the truck has officially been ordered
2. Ron asked that when DTC comes through if they could get dedicated fax line.
3. Tim Oralls will be out for shoulder surgery in the near future. Ron questioned if he could hire someone to take his place while he is out. This matter will be looking into as to if a person can be hired full time and not receive benefits.
4. Ron questioned the status of setting up a highway committee. Bill stated he is looking into it further.
5. Ron stated once again that the 2013 – 1Ton is rusting around the under carriage an he would like to replace it before it gets to bad. Ron stated it is still a good-looking truck and would have value to the public. Ron would like to replace it this fall.
6. The 2005 Loader needs a paint job, Sam contacted Tepco and the cost would be $4,000 – 4,500 for a new paint job. Ron stated this loader will be going to the gravel bank in Afton soon.
7. Ron questioned if he was going to get summer help this year and if they had to be 18. It was explained he probable would but they must be 18 yrs of age per the labor laws.
8. Been out cutting brush
9. Out 63 times in 2018/2019 snow season clearing roads. That is down from last year of 78.
10. Working on equipment
11. The 2007 International needs a steering box and a power steering pump.
12. The 2013 1Ton needs fuel and transfer pump.
13. The 2007 International needs a clutch job and stadium quoted it would cost about $3318.96
14. Ron has been reviewing as to what roads he would like to resurface this year. He will get back to the board with what roads he feels are in need to be done.
15. Cobleskill stone contacted Ron because they want to get trucking stone.

Supervisor
1. Received a donation from Kingswood Methodist.
2. Chad Trimbell will be getting in contact with Bill as to what needs to be done for the switch from Reeds generator service to Chad servicing the generators.
3. Ed Engleman has submitted the grant for the fire Tower for about $80,000.
4. Bill needs to look into the right of way for the fire tower. There seems to be some confusion.
5. A resident requested a school bus stop sign somewhere on finch hollow. Bill and Ron are going to see exactly where the resident needs it and if it is needed.
6. Lynne submitted the school house rental form to Michelle. There are some changes the board would like. Michelle is going to type them up and send it back to Lynne for her to review.
7. NYC is resurfacing co rt 27 from Loomis to St Rt 10 and asked if the Town had a problem with them dumping fill by Mormon Hollow. Bill stated that it is City property so not sure what the Town has to do with it.
