The regular monthly meeting of the Town of Tompkins Town Board was called to order at 7:03 pm in the Town meeting room, Trout Creek, NY.

Present:
1. William Layton – Supervisor
2. Howard Buttel – Councilperson
3. Tim LaTourette – Councilperson
4. Peggy Backus – Councilperson
5. Carl Stuendel – Councilperson

Others:
1. Ronald VanValkenburg – Hwy Superintendent
2. Michelle Phoenix – Town Clerk
3. Nancy Roberts – Bookkeeper to the supervisor
4. Willy & Ann Wood – Town residents
5. Kristin Janke Schneider – Delaware County Planning Dept

Pledge to the flag was led by Howie Buttel.

Guest Speakers:
Willie & Ann Wood – attended meeting to observe.

2013 Preliminary Budget
On motion by Buttel, seconded by LaTourette, it was moved to accept the 2013 Preliminary Budget as the Adopted Budget and place on file.
Vote: All AYES – Motion Carried

Minutes Approval:
On motion by Backus, seconded by Stuendel, it was moved to approve the minutes of the Board meeting held on October 9, 2012.
Vote: All AYEs – Motion Carried.

Monthly Financial Reports:
Town Clerk’s Report:
On motion by Buttel, seconded by LaTourette, it was moved to receive, approve and place on file the Town Clerk’s monthly report for October 2012.
Vote: All AYEs – Motion carried.

Supervisor’s Report:
The Town’s monthly financial report was presented by Nancy Roberts and reviewed by the board.
On motion by Stuendel, seconded by Buttel, it was moved to receive, approve and place on file the Supervisor’s November 8, 2012 Financial Report.
Vote: All AYEs – Motion carried.

Other Reports:
Report – Planning Board – None
Report – Assessor – None

Report – Highway Superintendent
1. Trucks are all ready for Winter
2. All roadwork is done for this year, 4620 yards of gravel have been used on roads in 2012.
3. Boom mowing has been done on Hathaway Pond and Franskevicz Road.
4. Will be purchasing 8 back truck tires costing around $5,000 total; $628.13 per tire. In addition he will need front tires and rims.
5. Hurricane Sandy – Minor damage in the area; mainly just downed trees and limbs.
6. The computer in the shop has crashed and Howie has come over and took a look at it and stated that the hard drive is gone. Stuendel stated he will look into prices on a new desk top.
7. Started hauling grit.
8. Town of Colchester wants to purchase the 1989 International for $18,000 and Town of Deposit would like to purchase the Sander for $3,200. On Motion by Stuendel to accept offers for the purchase of the 1989 International to Town of Colchester and the purchase of the sander to the Town of Deposit, also the above mentioned will be sold as is, Seconded by Backus.

Report – Dog Control Officer – None

Report- Supervisor
1. Resolution 25-2012 – On motion by Backus, seconded by LaTourette, to abolish the position of Town Tax Collector, and the Town Clerk shall assume the powers and duties of Tax Collector.
Vote: All AYEs – Motion Carried.
2. On motion by Backus to appoint Michelle Phoenix (Town Clerk) as Tax Collector, 2nd by LaTourette.
Vote: All AYEs – Motion Carried
3. On Motion by Stuendel to rescind Appointment of Wendy Layton to the position of Sole Assessor effective October 9, 2012, 2nd by Buttel.
Vote: All AYEs – Motion Carried.
4. On Motion by Stuendel to Appoint Wendy Layton as Sole assessor effective November 1, 2012, seconded by Buttel.
Vote All AYEs – Motion Carried.
5. Received a letter from NYSDEP for land acquisition on Finch Hollow. Kristen from the Del Co. Planning board was present and stated they will review this letter and take care of it. They will submit a comment letter and a public hearing will be scheduled to coincide with an upcoming Town of Tompkins Planning Board meeting.
6. Revisions of the Subdivision Regulations were reviewed by the board. On Motion by Stuendel to send the revisions to Delaware County Planning for review, 2nd by Layton.
Vote: All AYEs- Motion Carried.
7. Nancy presented the Town’s Hazard Mitigation Plan for review. Kristen from Co. Planning stated this need to be done so that the Town can receive FEMA money. The Board Commented on the plan and Nancy will make adjustments and send this off to Del Co. Planning so the book can proceed with the rest of the process.
8. After much discussion on if Ron should receive Administration fees from FEMA work he had done, on a Motion by Stuendel, seconded by Layton, to pay Ron the same amount that Nancy had received for administration fees of $950.00.
Vote: All AYEs – Motion Carried.
9. Received an email on October 7th from Deb Fleming stating she will have the signs cut and painted and put up after Halloween.
10. 12 Trees have been planted along the border of the Town Building property line, costing $1140.00
11. After much discussion, on motion by Backus, seconded by Buttel to purchase BAS town Clerk program and the BAS Tax Collection program.
Vote- All AYEs – Motion Carried.

Abstract of Claims
On motion by Backus, seconded by Stuendel, it was moved to approve the Abstract of Claims for November 8, 2012 as follows:
General Fund: $10254.05
Highway Fund: $17560.00
Capital Fund $1140.00
Vote: All AYEs – Motion carried.

Reading back of the minutes:
On motion by Buttel, seconded by Backus, it was moved to accept the minutes as read back.
Vote: All AYEs – Motion Carried
