The regular monthly meeting of the Town of Tompkins Town Board was called to order at 7:00 pm in the Town meeting room, Trout Creek, NY.

On motion by Buttel seconded by Stuendel it was moved to approve the minutes of the June 8 2009 meeting as each member had received a copy.

On motion by LaTourette seconded by Stuendel it was moved to receive, approve and place on file the Supervisor’s and the Town Clerks monthly reports.

Reports-Superintendent

  1. Crusher – (should we sell it?) Hwy Superintendent will inquire about prices.
  2. Kerryville (Peter?) had damage in the 2006 flood, complained about the work that was done. Bullock Hill  Rd will be topped as soon as weather permits and the oil gets here,2.2 miles.
  3. The 930 loader is broke down. Broom Dana Wagner is trying to fix the motor he’s working with Leonard Bus Sales, Deposit.
  4. 105 loads of gravel have been drawn to here.
  5. Green Chev leaks diesel fuel, it is under warranty.
  6. Excavator had a speed sensor valve put on.
  7. Brush cutting and ditch work are done on Bullock Hill Rd.
  8. Chase Brook and Carcass Brook Rd – doing regular maintenance.
  9. Mormon Hollow Rd doing ditch work.
  10. Hwy Superintendent will ask about the extended warranty on the Excavator.
  11. Having trouble with one of the trucks it is down at Stadium.
  12. Generator, Taggart hooked it up and Amerigas has to come and hook up the gas.

  3. Copier – On motion by Buttel seconded by Backus it was moved to replace the copier, with( Russ Card, Binghamton) when the old one quits.  All AYEs – Motion carried.
  4. Courtroom Software – On motion by LaTourette seconded by Buttel it was moved to

order the courtroom soft ware and pay for the annual fee.  All AYEs – Motion carried.

The Board discussed the painting of the doors in the Town Hall.

On motion by Backus seconded by Stuendel it was moved to hire Jermery Johnson to paint the doors with Harry Johnson’s supervision and pay him $15.00 per hour as the job was started  at $15.00 per hour. To be finished by August 1, 2009   All AYEs  Motion carried.

Carl Stuendel brought up the wind towers – about the set backs. It was suggested that the full Board attend the next Planning Board meeting on Thursday August 13, 2009 at 7:00pm..

Helen Zandt is concerned about who has keys to the schoolhouse. Need to change the lock and get new keys.

On motion by Buttel seconded by Stuendel it was moved to change the lock and get 3 keys  ( Helen, Bill and Town Hall).  All AYEs – Motion carried..

The union agreement was approved by all. The Board is now waiting for the written contract before Board approval at a meeting.

Need to have the summer help wash the outside of the Town Hall building.

Correspondence:

Talked about the letters written by the people living on the Faulkner Rd and Granton Rd about the noise from their neighbors. Waiting to hear from Tom Evans to get word from the State.

Nancy Roberts went over the financial reports with the Board. It looks like we are in good shape so far.

On motion by LaTourette seconded by Stuendel it was moved to approve the Abstract of Claims for July 2009 as follows;

General Fund: $ 2,276.41

Highway Fund:$58,444.62

Reports-Superintendent:

Bullock Hill Rd approximately 25pipes were changed. Ditching is done. Concrete blocks, price was right 3’ $25 and 6’ $50.Tim Bennets check, Supervisor will put a stop payment on said check and issue a new check. On 6/12/09 Tim LaTourette will oversee the cutting and chipping of branches by the  ballfield. Mark Layton came and changed the lights in the Hwy Building. Stone is all here. We got the blue book o the ice storm $74,646.61. The gravel bank, they are now crushing gravel after a few problems were solved.

  2. On motion by LaTourette seconded by Backus it was moved to appoint Angela Porpora to the Planning  Board.  Vote: 4 AYEs  1 proxy AYE   Motion carried.
  3. Adding on to our Building.   Tabled until next meeting.
  4. Summer help 1-2?   The  Board decided on 2 people for summer help.
  5. Signs for the Town Hall and Town Hwy Building  Tabled until next meeting.

Supervisor Layton will call Russ Thurston about the painting of the doors..

The Board decided to put the Cannonsville Cemetery money into a 3 month CD.

Ron VanValkenburg will look at N Dry Brook Cemetery washout.

Correspondence-

Supervisor Layton read a letter that Wayne Marshfield (Hamden Supervisor)wrote to the youth Bureau about the reduction of money received from the State.

The Town of Tompkins will turn over their money that we get from the State to the Tri Town  Boys and Girls club.

Union negotiations have been changed to June 23,2009 @ 5:30pm.

The public hearing on the Local Law #1-2009 was called to order at 7:00pm.

The public hearing was opened for discussion of the Local Law #1-2009 –changing terms for Supervisor, Town Clerk, Tax Collector and Hwy Superintendent.
As no one from the public present motion to approve Local Law #1-2009 changing terms for Supervisor, Town Clerk, Tax Collector and Hwy Superintendent from 2 years to 4 years was made by LaTourette seconded by Stuendel.
Vote: All AYEs – Motion carried.

Local Law #1-2009 now has to be submitted to the voters of the Town of Tompkins in the November General Election, then sent to Albany to be filed. When filed, it will become law.

Motion to close public hearing #1 was made by Stuendel seconded by Buttel and to call public hearing #2 to order at 7:05pm.

Gale Neale and Mike Jastremski presented the resolution for the adoption of the West Branch Delaware River Stream Corridor Management Plan to the Board.

On motion by LaTourette seconded by Stuendel it was moved to adopt the resolution for the West Branch Delaware River Stream Corridor management Plan.
Vote: All AYEs – Motion Carried.

On motion by LaTourette seconded by Backus it was moved to approvethe Memorandum of Understanding (Soil and Water).

Motion was made by Stuendel seconded by LaTourette to close public hearing #2 and call the regular meeting to order at 7:20pm.

Amy Glerum and Michelle Phoenix came to the meeting to ask if they could use the old jail for the celebration on July 25-26. The Board OKed it. The committee will talk with everyone involved in the celebration so that everyone is on the same page.

Rich Otis and Ivan Orisek came to get an application for special use road permit signed.  The Board rejected the permit.

On motion by Backus seconded by Buttel it was moved to reject the Road Rally in the Town of Tompkins.

Correspondence
Letter from Assemblyman Cliff Crouch in response to a letter from the Town was read by the Supervisor in short the Board of Elections has the say over the Kelsey voting district #1.

Chips money is $129,573.75 Superintendent got a letter of confirmation. Did cold patch-cut brush- did ditch work and changed pipes. Worked on the baseball field. Truck boxes were sand blasted and painted. Took two trucks to Stadium – fixed the air conditioning in one, and sent the other to Milton Cat. The engine on the Broom went out again (120 hours) sent to Northeast Cummings, Syracuse. Ron brought to the Boards attention the fact that he has to do a ditch along beside Dave Gatje’s garage down to our road, to save our road from washing out.

Talked about lawn mowing. We got the check (537) for Mang Insurance for over charging us. Should we add on to the Town Hall- Supervisor Layton got the OK to have some sketches done.
Signs for the Town Hall and Hwy Department Ron will check on a name for use.

Tom and Mike from the County Planning Board and Gale from Soil and Water Commission.
Tom and Mike did a presentation and discussed the West Branch Delaware River Stream Corridor Management Plan – then Gale presented more information on said plan.
Tom Evans then talked about Wind Tower regulations-the Town Board and the Planning Board will do a workshop at the Planning Board meeting on may 13th with Tom as Coordinator.
The Town Board needs to think about a Cell Tower.

Opening of the bids for lawn-mowing and trimming
1-Daniel Gehl $49.00 per mowing
2 Nathan Glerum $40.00 per mowing

On motion by Buttel seconded by Stuendel it was moved to accept the low bid of Nathan Glerum for lawn-mowing and trimming of the Town lawns including Town Hall lawn, 50’ by 206 side of the salt Shed, School House lawn and Town Hwy Garage lawn.

Cannonsville Dam boat ramps- our Town Hwy Employees are drawing gravel for the ramps .Diesel fuel is down in price. Prices of boom mower 74,00 approximately and 79,00 approximately(4 wheel drive). Ron says CHIPS money is the same as last year $129,408.,28. It was decided to do 2.2 miles on Bullock Hill Rd. Have to stay within $10,000 of what the CHIPS money is.
On motion by Buttel seconded by LaTourette it was moved to do 2.2 miles on Bullock Hill Rd and to stay with in $10,000 of what the CHIPS money is.

2-4 year term for Supervisor, Town Clerk, Tax Collector,and Hwy Superintendent. Town Clerk to put public hearing for May 11,2009 meeting in paper.
3-Painting doors and wood on Town Hall
On motion by LaTourette seconded by Stuendel it was moved to give Russ Thurston $15 per hour to paint doors and wood on the Town Hall.

Carver Sand & Gravel $3.00 per ton
E&R Popes Excavating LLC $2.97 per ton
On motion by Backus seconded by Buttel it was tentatively moved to accept the bid of E&R Popes Excavating LLC to crush gravel.
Vote: All AYEs Motion Carried.
After some discussion by the Board they decided to pass this motion.
On motion by Stuendel seconded by LaTourette it was moved to have E&R Popes Excavating LLC crush the gravel for $2.97 per ton.
Vote: All AYEs Motion carried.

On motion by Backus seconded by Stuendel it was moved to pass Resolution #8 2009 transferring the Cannonsville Cemetery from the Cannonsville Cemetery Association to the Town of Tompkins.
Vote All AYEs Motion carried.

Other- James Fox and Russell Thurston to the Planning Board.
On motion by LaTourette seconded by Buttel it was moved to appoint James Fox as Chairman ( to replace Everett Rhinebeck) and Russell Thurston( to replace Carl Stuendel) to the Planning Board. Term to be 5 years.
Vote: All AYEs. Motion carried.

On motion by Stuendel seconded by Backus it was moved to have Ron Valkenburg ask if the Town Hwy employees will donate their time to drain the baseball field for the Fire Company.

On motion by Backus seconded by Stuendel the Town of Tompkins is considering to put in the paper about clean up days in May.

Tom spoke about changes in the Wind Tower Draft Law. The Board had to decide on a stand alone Wind tower draft Law or Site Plan review Law. The Board decided on the stand alone draft law.

Community Market.

Market will start 5-21-09 thru October on Thursday and Saturday.

On motion by Stuendel seconded by Buttel it was moved to approve the sign for the market.

The estimates on the generator were read as follows;

Blue Ox- 17KW Generator propane $12,141.00

Taggerts- 17KW Generator propane $10,950.00

20Kw generator propane $11,750.00

On motion by LaTourette seconded by Buttel it was moved to purchase the 20KW generator from Taggerts pending approval from CWC to use good neighbor money.

The ice storm December 11, 2009 Superintendent filled out paperwork and we could possibly get $24,000 from the storm. The one ton plow truck trying to get it fixed under warranty. The fuel tank is getting bad on the old Chevy-need the tank not the pump. Taking care of roads- cleaned and washed down the walls in the shop. We have gotten $15,000 for plowing from the county. Quotes from Suit-Kote $55,000 for one mile of road. Put out bid for someone to crush gravel for us in our bank,$3.00 per ton is what one outfit is charging, Superintendent brought up a boom tractor.

  2. Russ Thurston fixed the leak in the boiler room need to pay him.
  3. No state bid for oil filters
  4. Cannonsville cemetery- they want the Town to take over the cemetery, no decision was made.
  5. Resolution #4 (re. Wastewater Study) the Board and Supervisor all signed it.
  6. Amerigas is going to give us 300 gal of propane because they let us run out at the Hwy garage.
  7. Lawn mowing bids.
  8. On motion by Stuendel seconded by LaTourette it was moved to put in the paper bids for mowing and trimming the Town Hall lawn, 50’ beside the salt shed. The school house and the Town Hwy garage lawns.

Vote: All AYEs.

Association of Towns annual meeting –Carl Stuendel didn’t go because it was too expensive for the Town.

On motion by Stuendel seconded by Layton it was moved not to draw any more grit this year.

  1. Superintendent gave a price from Blue Ox for a generator. Need to have the Board members check for more price quotes for generators.
  2. Checked with NOCO about oil.
  3. Presented a paper from Town of Sanford about road damage from gas leasing companies.
  4. Christina from County Planning Board will meet with Ron Feb 11, 2009.
  5. Talked about abandoning a road- Seasonal part of Rock Rift Rd- Barbour Brook Rd above Waldo Bonkor’s.
  6. RMS will crush gravel for $3 per ton at our location.
  7. Superintendent brought in pictures of damage done to our road by Dave Stanton.
  8. The road crew has been maintaining and plowing roads.

  1. Financial update- Nancy went over the financials with the Board. The 2008 Annual Update Document was filed with the State electronically on 1/30/09.
  2. Amerigas let us run out of propane in the Town Hwy Garage- They came and filled the tank. The Supervisor will ask for a rebate because they let us run out.
  3. Teamsters sent us an Impasse request- Supervisor Layton mailed back the Impasse request on 2/20/09.
  4. On motion by LaTourette seconded by Stuendel it was moved to pay for the notary course. Vote: All AYEs – Motion carried.
  5. Wastewater Planning study was passed out to the Board to read and bring back to the next meeting.
  6. Delaware Planning Department (wind towers) at the next meeting.
  7. We got a rebate from Mang Insurance for charging us twice for 1 truck.
  8. On motion by Buttel seconded by Layton it was moved to give the Legion $400 and ask them if they would take care of the flags in Town.

  1. We got a check from the County for plowing $6842.33 for 12/17/08 thru 12/31/08.

Brenda Thurston DCO was at the meeting to as about raising the fees for the dog licenses. She will check into that.

On motion by LaTourette seconded Buttel it was moved to approve Resolution 2009 #7 concerning Planning Board members getting paid.
