Minutes Approval:
On motion by Stuendel, seconded by LaTourette, it was moved to approve the minutes of the Regular Board, Organizational, Board of Health and Appointment meeting’s held on January 8, 2013.

Monthly Financial Reports:
Town Clerk / Tax Collector Report:
On motion by LaTourette, seconded by Stuendel, it was moved to receive, approve and place on file the Town Clerk/Tax Collector monthly report for January 2013.

Supervisor’s Report:
The January 2013, Supervisor’s monthly financial Audit was present to the board by Nancy Roberts, Bookkeeper to the Supervisor.
On motion by Stuendel, seconded by LaTourette, it was moved to receive, approve and place on file the Supervisor’s monthly financial Audit for  January 2013 Financial report.
Vote: All AYEs – Motion carried.

Report – Highway Superintendent

  1. Ron presented the board with a purchase order for the pipe that needs to be replaced on Mormon Hollow for $6,701.55
  2. On Motion by LaTourette, Seconded by Backus to approve the purchase order presented by Ron for the purchase of a 40 ft pipe in the amount of $6701.55
    Vote: All AYES – Motion Carried

  3. EWP Projects – Rock Rift and Readburn No. 2 are 100% done. Pine Swamp and Readburn No. 1 are still in design.  The Chamberlain Brook project is still waiting to hear from City for approval.
  4. Guys have been cutting brush on Walton Mountain.
  5. Have had minor repairs on equipment.
  6. Gravel Bank permit has been renewed and is good from Jan 29, 2013 – Jan 2018
  7. Will be getting $130,118 in CHIPS money.
  8. Stone and pipe bids will be going out in the papers and will set the opening of bids at the March’s Monthly meeting.

 

Report – Dog Control Officer
NYS Ag & Markets have done a Municipal Inspection report for Crescent Pet Lodge on January 17, 2013, and the reports shows the dog shelter to be “unsatisfactory” but also does state that it will be re inspected in apx 30 days and it is anticipated that all deficiencies will be corrected by that time.
Russ is due to have Inspection on Friday February 16th and at that time they will discuss with Deb Toth what steps need to be taken if the next inspection of Crescent Pet Lodge fails.

 

Report- Supervisor

  1. Received a resignation letter from Wendy Layton for her position on the Board of Assessment of Review due to her undertaking the new Assessor position.
  2. On motion by LaTourette, Seconded by Stuendel to accept Wendy Layton’s resignation for the Board of Assessment Review.
    Vote: All AYES – Motion Carried.
    It was discussed that upon investigation there was no need to replace Wendy’s position due to there still being enough members on the board after Wendy’s resignation.

  3. There will be a letter sent out too Mr. & Mrs. Decker in regards to the damage done to the sign located on Decker’s property. It was stated in the letter that LaFever has been reminded by Lamont of this issue and that it has to be dealt with in a timely manner.

 

 

Correspondence:
On 2/11/2013 a letter was received by Robert Beebe in regards to the City of New York v Town of Tompkins, Stating that the proposals will be presented to the DEP Commissioner during the week of February 11, 2013. Thereafter, any recommended settlement will be submitted to the respective principals, the City of NY and our Town.
At this point Beebe explained in the letter that things are in a “holding pattern”, which, giving these circumstances, He believes is acceptable to CWC.

 

Other:
After review and discussion of the membership renewal for the Del. Co. Chambers of Commerce it was agreed by the Board not renew membership due to the Board feeling as if there was no reason for the Town to have such Membership.

 

Abstract of Claims
On motion by LaTourette, seconded by Backus, it was moved to approve the Abstract of Claims for February 11, 2013 as follows:
General Fund: $122,494.14
Highway Fund: $19,861.03

The Town of Tompkins Highway Superintendent has requested that our town copy the posting of our neighbor, the Town of Delhi, and present it as our position as well.  So here it is:

It is the Highway Department’s goal to keep Town Highways in a passable condition during the winter months.  Any type of obstruction located in the Town’s right-of-way may hinder the ability of snow removal.

In an attempt to clear the roads, our drivers try not to damage any obstructions in the right-of-way; however, that is not always possible.  Therefore, any damage which may be done to mailboxes, fences and the like, while the Town Highway Department is trying to maintain the roads during the winter, will not be repaired or replaced by the Town, but will be the owner’s expense.

Vehicles parked on the Town right-of-way are also a hindrance when trying to clear the roads of snow.  Attempts will be made to contact the owners of such vehicles so they can be removed.  However, if the Highway Department is unable to reach the owner, or if the vehicle is not removed, the Town will have the vehicle towed, at the owner’s expense.

It is also a violation to plow snow across or shovel back into a Town Highway when residents clear out their own driveways and/or sidewalks.

The Town’s 2012 yearly financial report was presented by Nancy Roberts and reviewed by the board during the Annual Audit of books and was accepted as the Towns Monthly report.
On motion by Backus, seconded by LaTourette, it was moved to receive, approve and place on file the Supervisor’s 2012 Annual Financial Report as the monthly report.

Assessor – Wendy Presented and reviewed her monthly financial report with the board.

 

Building Inspector – Joe presented the board with a new Building Permit Fee Schedule.
Upon review from the board
On motion by Stuendel, Seconded by Buttel, to accept the fee schedule with the following changes.

On commercial Construction:

Tax Collector – Michelle provided the board with a tax collection report for the board to review.

 

Report – Highway Superintendent

  1. Questioned if the board had heard anything about the permit for the gravel bank. Bill stated he has heard nothing new but will look into.
  2. Plowing contracts will run out on August 31, 2013, Ron stated that need to be reviewed before signing new Contracts when they come.
  3. The pipe on Mormon Hollow by the Kehr residence needs to be changed. Ron stated that 40ft galvanized squash pipe costs about $6,700 and 30ft galvanized squash pipe costs about $5,200. Ron stated these are not exact prices. The Board suggested that Ron get prices and bring back to next meeting.
  4. Plowed and sanded when we had snow.
  5. Cutting brush
  6. 2006 went to Milton cat to have the ECM board replaced.
  7. They have plowed 24 times this season that is up from 14 times last season.
  8. Ron Discussed how he would like to have the Fire District get their own tanks for fuel. After much discussion between the board and Commissioners Higley and Baker. It was decided at this time things with the FD getting fuel will stay the same but the Commissioners will find all keys that FD members may have in their possession and return them. Also when FD needs fuel in an emergency and Kyle McLaughlin is on the FD Call he will assist in filling the trucks. There will also need to be two signatures on the fuel sheets, one from the FD member getting the fuel and one from the Town employee. The Board also advised the commissioners to look into getting fuel and tanks for year 2014 and add it to their budget.
  9. Ron provided the board a write up in the paper from another Delaware County town about Friendly Winter Reminders. – Carl will put the Town of Tompkins Winter Friendly Reminder on the website.

 

 

Report – Dog Control Officer – None

 

Report- Supervisor

  1. Received a letter from Bob Beebe stating that the City is in the process of approving his template. If for any reason this negotiation fails, the Town of Tompkins will want to make use of the TLAP program admistered by CWC.  The Town asked CWC for a one month extension on the enrollment deadline.  CWC and NYC granted this extension.
  2. The Town Sign was installed and it was discovered that the installer had hit the telephone wire and the sign needed to be removed and phone line fixed. The sign is now back in and if there is going to be a cost for the damaged phone line it will go to the installer of the sign. Nothing has been heard about the installation about the other sign for the other end of town.
  3. NYMER Inspector has been here and most went well though there are some minor issues to be addressed. NYMER will send a report on issues to address.
  4. Received a letter from the Delaware County Election board about the possibility of closing Kelsey’s Polling place. Carl stated he will address this with Paul Bartholomew.
  5. Bill discussed with Ron on if Ron had taken any consideration on doing something with the dust issue on Chamberlin Brook. After much discussion nothing was resolved.
  6. Bill called the Association of Towns about the FEMA event Administration fees. After much discussion between board members, they now have a better understanding how to use a portion of the awarded Administration fees to compensate town employees who do the administrative work for a FEMA event.  The board realizes they may have done things incorrectly (or at least could have done a better job of making things transparent) with regard to the payment of town employees who did the administrative work for several prior FEMA events. In the future if there is a FEMA event the board will discuss a rate of pay for administration fees for Ron and Nancy who have been appointed as the town’s FEMA Administrators for the year 2013.

Amended Sub Division Regulations
On motion by Stuendel, seconded by LaTourette it was resolved that the Board of the Town of Tompkins hereby determines that the proposed Local Law No. 1 of 2013 is hereby adopted as local law entitled “Amended Town of Tompkins Land Subdivision Regulations”, and be it further Resolved that the Town Clerk is hereby directed to take such actions as are necessary to implement this resolution and effect adoption of the Local Law.

Salaries:
On motion by Layton seconded by Buttel it was moved that the Salaries of the Town officers for the year 2013 are fixed in the budget and that the Supervisor is authorized to pay the approved salaries.

Highway Expenditures:
On motion by Buttel seconded by Stuendel it was moved that Highway Superintendent to be authorized gasoline, oil, fuel, tires, salt, calcium, batteries and such items to be obtained through state bid contract, also dust oil for use on Town roads with a limit of up to $1,000. Any purchase greater than $1,000 must be done through the Town’s purchase order system.

Report – Highway Superintendent

  1. Colchester has picked up the 1989 International and paid $18,000.
  2. The Sander has been purchased by Deposit for $3200.00
  3. Done hauling grit for this year and have only spent half the budget for grit.
  4. All trucks have been washed and waxed and minor repairs done.
  5. Equipment has been put in the creamery.
  6. Dana Wagner is going to make some corner post for the dump boxes that are rusting out.
  7. Ron would like to have the boxes and frames painted on the 4 trucks and use the money from the sale of the 1989 international, Ron will get quotes.
  8. Ron would like to replace both 1 tons.
  9. The 2006 International (John’s Truck) the waste gate on the turbo went and they are awaiting parts.


Report – Dog Control Officer

  1. Received a call from a resident stating she had seen a black and white dog running around on their property and was trying to get a hold of it for the DCO.  Never heard anymore back.
  2. Resident on Pines Swamp called stating they were missing a Great Dane
  3. Received a call from Del. Co. Sheriff Dept. requesting DCO assistance if needed with dogs, Sheriff called back stated no need for DCO assistance.
  4. Received another call from owners of missing Great Dane stating they feel neighbors up the road have their dog. They were told to contact Masonville DCO because the neighbors are not in Town of Tompkins District.
  5. Received a call from Resident on Dryden about their missing dog.


Report- Supervisor

  1. Received a letter from Bob Beebe stating that Mr. Paparella will be having a meeting soon about the litigation issues and issues will be resolved. Board members discussed that they need to make a decision soon on if they wanted to go with Beebe’s proposal or the CWC’s.
  2. Linda Ramsey advised Bill that employees have the option to use direct deposit if desired.
  3. 1 of the new “welcome to the Town of Tompkins” signs has been installed and is across the road from Lloyd Backus residence on 206. Bill has contacted the Walton Reporter to have a story and picture done with the sign and Hanna Wagner.
  4. Resolution 26-2012 – On motion by LaTourette, seconded by Backus. to adopt the amended subdivisions regulations after having conducted a SEQR review asserting there will be no environmental impact that result from these amendments.
